of Toll Road on Klamath Falls,
Bend, County Road.
It appearing to tho County Court
at this time that the old county road
from tlio intersection with tho State
Highway nt tbo cap on Fort Klam
ath Hill in Klamath County to the
county lino north of Crescent, Ore
gon, Is llttlo used for local travel:
nnd that there are very few residents
on said described road; that it Is so
located that thero is little or no local
labor along tho line ot said road,
and that for tho county to'iralntaln
said road In a passable condition
would entail a very heavy expense,
tar out ot proportion to the benefits
to be derived; nnd that each year
during the period of from about, the
first day ot December to about the
first day of June said Toad is block
ed by heavy snows and is ordinarily
abandoned during the greater por
tion of said time by the traveling
public owing to the difficulty of
passing through the heavyy snows In
the winter time; and that the County
Is at present time, with the State,
constructing a new highway between
the points mentioned, and the coun
ty does not desire to divert money
from said highway construction for
the purpose of maintaining a road
tbat (wilt- shortly be abandoned 'al
most wholly by the public: and thnt
there Is now little or no local labor
along said old county road;, and It
appearing expedient and lawful that
a toll road should be established on
snid old countr road, and tho Court
being now fully advised la the
premises,
IT IS HEREBY ORDERED that
said road, between the termini
above mentioned bo leasee to any
person or corporation to open. Im
prove and keep same in repair for
the period ot five years between
December fjrst and June first In
clusive only, .with the risht in con
sideration thereot to collect nnd re
ceive tolls for travel thereon as pro
vided by Chapter XXXIX, T"le

leasing of the old county road from
the intersection with the State High
way at the gap on the Fort Klam
ath Hill to the county line between
Klamath County and Deschutes
County, Oregon, for toll purposes,
for a period of live years, and to be
used tor toll purposes from Decem
ber 1, to June 1, ot each year only,
will be received at the office ot the
undersigned until 2:00 o'clock P. M.
on the 28 tli day of February, 1925.
No bid will be considered unless ac
companied by an undertaking,, exe
cuted by two or more sureties. In
the sum of. $2,000, to be, void upon
the condition that the' bidder, If the
lease is awarded to him, will within
ten days thereafter enter into the
contract for keeping the road, and
give tho undertaking to secure tho
performance thereof as provided by
law. The County Court reserves the
right to reject ary or all bids.
