The next etep was a writ ot re
plevin, which was served by Cor
oner Whltlock. This writ was rec
ognized by Murray, who then put
up a redelivery bond, which left
tho property In question still in his
possession. When the sheriff still
fulled to get possession of tho pro-,
perly, ho asked for a dismissal, of
the. replevin suit, which was grant
ed over Murray's protest, his attor
neys being present and advising -the
court, according to the. complaint,
that the bond had been posted nnd
accepted. The order, which appear
in tho complaint, sets forth that no
stops had been taken to secure the
property and that tho defendant,
Murray, had not been represented
la court. - 1
It was In tho effort to gain pos
session of this property by Deputy
Sheriff Hawkins and assistants that
the gun was drawn. Murray m-a
arrested, lndlctod, and placed Under
bonds to keep the peace, all ot which.
ha now claims, was Illegal and un
warranted oppression.
Eventually the whole matter came
lo a head In 1022, after Judge Ktiy
kviiduH's rusigiiailon, when Judge
C, F, Btono was temporarily on the
bunch to fill the vacancy, in tho trial
of a suit filed by Murray, unking
that Holding and Wiest be compelled
to uhldo by their contract. :

soon after dismissed.

quitted. '. It was generally supposed that
these victories In tho circuit court
had satisfied ' the former publisher,
and this echo of tho old feud comes
as a surprise to most peoplo. Tho
suit for damage will be tried be
fore tiie federal court at Portland.
