Necessity of bringing n legal dis pute to a closo at somo point Is said to havo Influenced tho policy of tho court In this regard, a policy which has stood slnco tho days of ChlcJ Jtistlco Marshall. A secondary conslff oration Is tho fact that tho court Is always from eighteen months to two years behind Its calendar and, unless optimistic attorneys woro curbed somowherc, tho most trivial "cause" might bo prolonged almost Indefinite ly. To their surprise tho court granted the rehoarlng and finally reversed Itself In part by declaring tho entire act unconstitutional. It was this de cision which led directly to enact ment of tho Sixteenth Amendment giving Congress tho power to lovy a tax on all Income, no mattor from what source dorlvod, Tho Amend ment did away with the constitution al restriction which forbade tho Im position of a direct tax unless it was apportioned In each state according to population.
