Roques as minister of, -war.
It was stated some days ago that
General Gallleni was ill.
Admiral La Cazo was appointed to
take his place temporarily' and com
bine his functions as minister of ma-
jac-with those of the war ministry.
Later the definite appointment of
General Roques was announced.
General Gallleni has been the
French minister of war since October,
1915. Before that ho was military
governor of Paris. Before the war '
broke out there had been a feud of
thirty years' standing between Gener-i
als Joffre and Gallleni. They had
not shaken hands nor exchanged j
icuui siccuugs uurinK mat period.
"With the declaration of war they bur
ied the hatchet and promised to co-
operate with each other to the fullest
degree for the- good of their country.
Since then there have been no Indica
tions of a reopening of the feud.
Friction with Senate
There has, however, been frequent
rnction between Gallleni and the
French senate as a result of which
Gallleni has more than once threat
ened to resign. Ex-Premier Georges
Clemenceau, head of the senate army
commission, has been an outspoken
critic of the ministry and of the con
duct of the war.
Much of this criticism has been di
rected against alleged faults in the

the place, so there Is no danger of

The defense worked hard to show
.Todd vindictive toward Lawrence, re
calling a fistic encounter between
the two men after some heated words
In which Todd accused Lawrence of
retting fire to JQorsey Johnson's barn,
after which Todd shot Lawrence,
young Kuehne struck Lawrence and
the two took the defendant to Merrill
.He was also questioned regarding
vrltlng, with others, to the pension
bureau and the bureau of naturaliza
tion suggesting that Lawrence be de
ported. Asked If he would like to
see Lawrence sent out of the country,
the witness replied that he would, to
tell the truth about It.
He was also asked If he had told
J. O. Swindler since the shooting that
"if they let the s of a b out
(meaning Lawrence) they'll need a
box for him," and replied in the neg
ative, and answered the same way to
a question regarding his telling
another neighbor that they wanted to
cinch Lawrence and get him out of
there.
On re-direct examination, Todd ex
plained that be bad asked the neigh
bor whether"Bome range cattle had
been killed, In order to protect his
own stock, not to cinch Lawrence.
The state also attempted to Introduce
Mrs. Kuebne's story to Todd regard
ing Lawrence driving her off the
homestead, but this was ruled out

State of the best evidence yet in
troduced by the prosecution in sup
port of Its contention that Lawrence
shot "Uxa. Kuehne from the front
porch tos given this .forenoon by
Constat tte T. M. Durham of Merrill.
He told of .finding two shotguns, a
80-30 automatic and a 36-20 lever
action rlflV in ibe house occupied by
Lawrence ajnd itke Hunters, and two
other guns which bad not been shot.

garding the ejectment of such guns
as found, whether they would always
throw tho shells' the same distances,
etc
There was some little battle over
the asking of a question by Renner
to ascertain If a man on the steps
could see where Mrs. Kuehne was
found wounded. There were several
objections before this was put In
manner suitable for an answer,
'On the rulings of this court, the
defense has been able, with leading
questions, to draw out matters and
go Into the defense on matters not
taken up In the direct examination,
enabling them to do what they ought
not to be permitted to do," said Onelll.
After some reamrks from Kuykendall
to the contrary, Onelll re-stated the
objection, saying the defense was go
ing Into the defenes Illegally on a
pretext of cross examination, after
which Knyltendali ordered Renner to
put the questions differently, In con
nectloh with some stated point of the
direct examination.
Renner then asked If a roan stand
ing on the porch where the shells
were found could see Mrs. Kuehne,
where she was found, at a point
ninety-four feet north and, a little to
the east of the porch. The answer
was that she would be visible, and
the view from there would be un
obstructed.
The defense also asked questions
to Indicate that Durham had mixed
the shells up considerably on bis way
to town,-and had told others that be
could not tell then just where he
had found them.
Orson Seals testified that be and
his wife were driving to Merrill last
spring, Hind while passing Lawrence's
place they had a talk with Lawrence,
in which the latter s tat edx that "that
old bitch (meaning Mrs. Kuebne) Is
down there again, and If she doesn't
quit bothering me, I'll murder her."
A recess of half an hour was taken
following Beals' testimony,
Mrs. Beals was tho last witness for
the state, being called to corroborate
her husband's testimony.
