The sums so spent wcro prac tically thrown away, as is tho case with all temporary repairs to dirt highways. The importance of the Shipping- ton roadway as a thoroughfare be tween the city and the wharves dur ing the summer season, and between the city and the lumbering industries situated nt tho foot of the lake, both winter and summer seems to cry aloud for its improvement in some permanent manner. It seems to be pretty generally conceded that the roadway should be Improved this year, but how, in what manner and at what cost, no one seems to be prepared to say or to advance a definite plan. I have been requested to present my views In this connection 'and I shall do so as briefly as possible. In doing so I shall proceed on the theory that the Klamath Development com pany is unable, financially, to make the improvement, and, secondly, that the property along the right of way will not support a bond issue suf ficient to finance the imprevement: and this without regard to the charac ter or cost of the improvement. (I want to make the statement right here that the success of the plan I am about to unfold hinges almost entirely on the cost). To proceed. It is my understand ing, and I think it is within the mem ory of quite a number present, that the Klamath Land and Transporta tion company about the time they es tablished or initiated their street car service on Main street and California avenue, contemplated a belt line, run ning on the route indicated to Ship pington and back over Oregon avenue to Main street; that with that end in view the company had a grade established on, and the roadway graded over the route or most of it that It is supposed to follow with this proposed improvement. It is therefore my opinion that whatever improvement is agreed upon, that it will answer every pur pose if laid on the grade established by that company for its street car service or practically on the road bed as It stands. The cost of cuts and fills necessary to bring about a boulevard effect adds Tery materially to the cost of an im provement as I shall presently chow; anB I can see no sufficient reason why that luxury should be indulged in council at one time appropriated and tentlon to three of the Improvements termlned on, the approximate cost would vary, The total cost of the Eighth and " ",us " wunwi Ninth street improvement was $15,- eome elShteen month! There was a charge of $12 for catch basins; $1,629 for sewer pipe a total of $9,260 for Items that I believe would or should not figure. The total cost of the Third street improvement was $19,647.98. Included in that cost was a charge for excavation of .$4,495.00 Included in that cost was a charge for excavation of 2,183.40 Included in that cost was a charge for fill of 3,065.60 proved much cheaper. The test has never been made, however, and we nre still in the dark on that matter. Somo have advocated four Inches of crushed rock with a filler of cinder oiled. Supposing, for the sake of the dis cussion, that the character of the Im provement has been agreed upon, and you have tho engineers' specifications nnd estimated cost, how are you go ing to proceed to put her through? The total cost of the Sixth street Improvement was $29,245.16. Included in that cost was a charge for cut and fill. .$ 6,702.45 Included in that cost was a charge for paving of . . .$20,281.60 21,714 square yards at 93 cents per square yard. The width of these improvements varied. Third, Eighth and Ninth streets are practically twenty-four feet, except from Main to High, where it is forty feet. Sixth street is full width, forty-eight feet. In my Judgment, based on what I have seen of the Pacific highway and from reports and accounts as to what has been done and is being done else where In road Improvements, a six teen toot roadway is ample for the traffic between this city and Shipping-ton. Aside from the fact that sixteen feet Is ample, it is evident to the un prejudiced mind that under all the circumstances surrounding this pro posed Improvement you will do well if you are able to finance It for that width. Estimating the distance from Delta street, the end of the pavement on the Eighth and Ninth street improve ment, to the boat landing at one mile and a quarter, and the improvement of the roadway at sixteen feet, using the cost of oil macadam as a basis at 95 cents per square yard, the par ing alone would cost $11,146. Using wood curb at a cost of 22 cents per linear' foot, add $ 2,900 SAXON SIX A big touring car for five people The evidence is this "Six" excels . And now at the end of over a year In owners' hands. it seems clear that Saxon "Six" has fairly earned its place at the top of its price class. This fact should win a moment of your consideration; for the verdict of performance carries weight. And the price of Saxon "Biz" a new price for a quality car has caused critical buy ers to question higher-priced can. For they see in this "Six' what can be saved to them through modern methods, skilled engineer ing and big output. Let us show you the Saxon "Six." assist In this matter and point tho way; more accurately speaking, to clear away some false Impressions that have become fixed in the minds of a good many of our people. It seems to be the prevailing idea or notion that the charter stands in the way; that tho city Is tied down to one, and only one way of making or financing an Improvement of this nature. I have never been Impressed with that idea; neither do-1 think a care ful perusal of the charter warrants such a construction. The charter unequivocally delegates to the council the power and author ity to Improve streets and highways at the expense of the adjacent prop erty. That power Is found among the powers delegated to the council in Sub. 12 of Sec. 87, p 28. Sub. Gl',4 of same section, p. 36, delegates the power to do so either at the expense of the adjacent prop erty or at the general expense of the city. Under the power, granted, it was necessary to provide specifically the method of procedure to be followed If the council determined to make the cost a lien upon the adjacent prop erty; the method of creating liens could not safely be left to judgment of first one council and then another. Therefore, a uniform procedure is provided in the charter, but the same particularity was unnecessary to ren der effective the power and author ity to construct an improvement at the expense of the city. There is a principle of law, as old as the municipal law Itself, to the effect that where an express power is delegated to a municipality the power necessary to carry It into ef fect is implied. Having established by reference to the charter that the city has the authority to Improve a highway at the general expense of the city, there yet remains to be considered the pro cedure to be followed in carrying that power and authority Into effect funds for that purpose. Therefore. the council is legally powerless to ( expend nny of the funds provided for, 19 1G for thnt purpose. ! Apparently we are up against the proverbial stone wall Let im see whether we arc or nof Granted, that the plans, specifica tions and engineers' estimnto for tho Improvement of tho Shippington high way have been approved by the coun cil; that the cost of the Improvement will bo $ ; that It Is necessary to make tho Improvement this year. My suggestion Is thnt tho cost as shown by the estimate of the engineer be divided into three equal parts of each, payable In one, two and three years. Submit to the people at the general election to be held May 1, these two propesitions: First Shnll tho common council improve the Shippington roadwny from Delta street to Shippington nt tho expense of the city nt n cost of In accordance with the plans and specifications on fllo? Vote yes or no. Second Shall the common couu-, ell be authorized nnd directed to In clude in Its 1917 budget the sum of $ the same being one third of tho cost of Improving the Shippington roadway from Delta street to Shippington; and In Its budgets for each of the following two years a like sum of $ for the same purpose. . Granted, that both propositions are answered in the affirmative. Then let the council proceed with tho Improvement, Issuing warrants against the Shippington road improve ment fund in three series, payable In one, two nnd three years to the con tractor. Arrange with the two banks to handle tho warrants at par as an investment to insure bids on a cash i basis. This plan or Idea has this advant age: you know where you are at the moment the votes are counted. I think it should cort less than the first named amount.
