produced.

ture of the Wllson-Undorwood bill
was declared void by the courts, tho

board and necessitate re-enactment
of an entirely new measure by Con
gress.
"Two chief foatuies of the bill
which have been under Are," said
Representative Hull to the writer,
"are the clauses fixing the graduated
tax the surtax upon incomes accord
ing to their size and the provision
for taxation of dividends of insurance
companies. Both are beyoad criticism
of any fair minded person, and also
beyond the reach of persons who
would attack their constitutionality

"In drawing that part of the bill
wo used exactly the word proscribed
in foderal court decisions, to prevent
any test of the law In the courts. If
you wjll examine tho bill carefully
you will note that wo declare that
dividends' of the Insurance compa
nies ore taxable. We did not use the
word revenue, or Income, or proceeds
but tho word 'dividends.' This has
been construed by the fedoral Judl
dlary In tho case of Knowlton vs.
Mooro, to mean the actual profits ot
the companies, derived not from over- tended friends.
