Department ot the Interior,
Washlnaton, Nov It. 1901).
Mr. Jacob Reticle, Klamath Falls, Or.:
Sir Iletcrrlng to tho petition
signed by yourself and others recom.
mending tho assessment ot 30 per
acre drainage ie upon lands within
the Klamath project, you nro nil
vised that tho various charges ngnlnit
the upper project and the Ttito lake
lands have not been more than tenta
tively considered by tho reclamation
service.
Thcro aro many Important points
to consider In connection with tho
settlement of water right charges for
this part ot the project, and final In
vestigations aro not completed on
which tho determination of tho out
can be based. The. petition forward
ed cannot rccclvo favorablo consid
eration at present becauso tho futuro
action of the department cannot be
determined until the plans ot 'tho
project aro fully developed. Very
respectfully,
R. A. BALLINOER, Secretary.
It would appear from this letter
that the secretary considers It possl
bte under the law to levy such n
drainage tax, and Intimates, though
toituri;, mai iuitu is a puMiuiiuy ui
such a tax being Imposed. If It la
the result would bo equivalent to tho
sale of tho land ns suggested by
Messrs. Demon and Drlggs, and
would be followed by n reduction of
the chnrgo against tho dry land,
though tho amount realised might not
reach the proportions hoped for by
those who favored tho Denson plan.
