Plantiff vs. Ben Haymond, as adminis trator of the estate of John Order of W oorls, decesseil, and persons ’ Court claiming to I m - the heirs of John Woods, deceased, De fendant*. Now upon application of A. E. Realties, Esq., District Attorney for the First Prosecuting Attorney District of Oregon, th«- above entitled Court hereby makes its order herein setting forth the following facts, viz:- that heretofore, to wit on the 27lh. day of March. 1903, one John Woods died inestate in Jackson County Oregon, leaving no widow, heir* or next of km, and leaving real and personal property within said state and county of the aggregate appraised value of Seven Thousand Two Hundred Seventy Two Dollars amlEighty Nine Cents; that thereafter, the Couuty Court of the State of Oregon for Jackson County duly appointed Ben Haymond as the administrator of the estate of said John Woods, deceased, — that said Haymond duly qualified as such ad ministrator and ever since lias been and is the duly qualified ami acting adminis trator of sairl estate; that, as such ad ministrator, the said Haymond is in pos session of the realty lielonging to the saul estate, as particularly described in the information herein filed; that said estate has been fullv administered; that at the time of his death, the said John Wood* was seized of the realty in said information described; that on the 17th. day of December, 1903, the Honorable George E. Chamberlain, Governor of Oregon, directed the District Attorney of tlie First Prosecuting Attorney District of Oregon, to file an information in the Circuit Court of the State of Oregon for Jackson County wherein said property is situated, in the name of the State of Oregon, for the recovery of all said property; that on the 17th. day of De cember, 1903, the said Governor of Ore gon duly appointed George H. Durham as special counsel for the Slate of Oregon to appear in said cause on tiehalf of plaintiff; that the paintiff claims and demands judgement that all said proper ty in the hands of said Ben Haymond, as such administrator of the estate of John Woods, deceased, has escheated to and become vested in the State of Oregon. And. in view of the premises, it is further ordered that all persons interest ed in said estate of John Woods, deceased, if any there be, shall appear in said Cir cuit Court of tlx* State of Oregon for Jacksun County, in the said proceedings of the State of Oregon vs. Ben Haymond as administrator of the estate of John Woods, deceased, and show cause, if any they h ive, within six weeks from the date hereof, why the title to said real ami personal property of said estate of John Woods, deceased, should not vest in the State of Oregon, and it is further ordered that this order shall t>e publish ed for six successive weeks from the date hereof, in the Jacksonville Sentinel, a weekly newspaper published in said Jackson County, Oregon, and it is further ordered that until the further order of this Court, the County Court of the State of Oregon for Jackson County ami the said Ben Haymond, as such administrator or otherwise, are hereby enjoined and re strained from, in any wise, disposing of any of the property of the said estate and further proceedings in said County Court in said estate, are hereby stayed until the further order of this Court.
