such contest briefly, within 30 days
from the t.me said persona shall claim
to have bee nelected. and then the act
further provided for the notice of hear
ing and how the contest should be car
ried on and placed the burden of the
costa of the contest on the county in
which the contest was held. And when
the state adopted the initiative and re-
ferendum laws in 1SM)7, a manner of
election contests wa sprovided for in
the | ew act. but the new act did not
repeal the old act. and as a conse
quence. we have two laws on the sta
tute books providing a manner of elec
tion contests.
To remedy this situation and force
the contestants to pay thier own coats
hereafter. I Introduced Senate Bill f >.
179 on February 2nd, providing for a
repeal of the laws of 1870. The bill
was referred to the committee on Elec
tions and Privileges. The members ol
that committee were: Sen. Allan By-
non, chairman. Burk Vice-chairman.
Joe Dunne. Mann and Fisher. The com
mittee held the bill from February 3rd
until February 21st and reported It
out without recommendation and after
canvassing the Senate. 1 found that the
opposition to the bill which was led by
Senator Bynon was sufficiently strong
to defeat It. so I withdrew the bill and
It was never voted upon.
Up to this point my batting average
in securing the passage of bills 1 spon
sored is zero, (with the exception of
the Thomas Bill) but no one can say
that any of the bills I have referred to
are without merit.
