deputy Labor Commissioner on the
ground that the bill wab unconstitu­
tional In three particulars: First. In

contract. Second, that It infringes up­
on Article IV. Section 22. of the con­
stitution which prohibits the revision
or amendment of laws by mere refer­
ence to their titles; Third, that It de­
legates legislative powers to the Board
of Control In violation of Article II.
Section l. and Article IV. Section t.
of the constitution. Both of these sec­
tions provide that the legislative pow­
er shall be exercised by the legisla­
tive assembly.
The Supreme Ccgirt. after an ex­
haustive opinion decided that this act
offends against no constitutional pro
vision. In the body of its decision, the
court said: The bill “ compels those to
yield to the state the largest contribu­
tion In the form of a salary redac­
tion who can best afford to do so.
W hile It la not an Income tax. the e-
conomlc reasons which support It are
more akin to thoee which support in­
come taxes than those which prompt
salary measures. The real purpose of
the law is to make income and outgo
meet."

energy had been expended to bring
about
a condition of mployment
whereby the taxpayer could earn In
wages or by the sale of commodities
sufficient to meet his taxes, as there
was to force wage reductions through
reduction of tax levies, we could have
accomplished more than we did.
