CLEVELAND, Ohio. Oct.22—An al­
most incredible deceit is charged a-
gainst Dr. S. P. Berry, a well known
dentist, who died here four months
ago, by the Victory Life Insurance
Company which is contesting the pay­
ment of a »5.000 policy to Dr. Berry's
beneficiary.
The basis of the company's action
Is substantially as follows: Accord­
ing to report for sometime prior to.
taking out the policy, Dr. Berry had
suffered with a malady which inter
fered prohibitively with his domestic
felicity. To remove this cause of in­
compatibility, Dr. Berry decided to
operate upon himself, using X-ray.
He did so. but unfortunately lacked
the knowledge to determine the exact
extent which he should treat himself.
As a result, he was burned.
The injury, set up within the body,
was not apparent on the surface, so
that when Dr. Berry sought a policy
with the insurance company. Its medi­
cal examiners were not able to tell
that he was suffering from X-ray
burns.
The company now holds that the
dentist did know and was aware that
they might prove fatal. He succumb­
ed shortly after the policy was issued.
The company has filed a petition In
the federal district court to have the
policy issued to Dr. Berry cancelled.

EUGENE. OREGON, October 23 —

your paper, about the first negro baby
born in Lane county. Ninteen years
ago on either the last of July or first
of August. 1912, there was a little ne­
gro boy baby born at the Mercy hos­
pital. The father was a contractor by
name of Washington, working on a
down-town building. The baby was
quite the center of interest aa a great
many had never seen a small Negro
baby. I was In th Mercy hospital at
the time and my nurse brought the
little fellow in for me to see. There
are probably several living in or near
Eugene that remember the baby.
