JACKSON COUNTY
ROAD BOND VOID
Salem. Ore.. Jan. 5!3. The lower
court of Jackson eountv was reversed
bv the supreme court today in the SI.
600.000 good road bond Issue. The
bond Isiue ia thus knocked out.
In an opinion bv Justice. Burnett,
reversing the circuit court, it was held
that aa a negative, restraining power
against Incurrina indebtedness the
amended section of the constitution
ia self executing: that the Dowers of
the eountv court are the same aa thev
were before the amendment onlv the
form of the restriction unon indebted
ness being changed, and that although
the legislative Dower of the atate had
Drovided the method of voting on the
election of officers adn upon direct leg
islative measures, it had never estab
lished anv plan for voting on eountv j
indebtedness, in the atsenco of which '
there was no authority for holding the ,
election in auestion and such amend-1
ment would not invalidate the proposed j
indebtedness, the amendment being in
that res Dec t not seif executing. The ,
court further held that eountv orders
or warrants are the onlv form in which
eountv indebtedness mav be evidenced
under the present state of legislation
and that counties have aa yet no Dower
to borrow money or issue bonds.
