The state is divided Into two water diririons, the first con eistiiu' of Klamath aud Lake counties and all th territory lyinc weet of ?! e Casjade mountains; the secoud com prisma the remainder of the state. The covernor is to appoint a superin tendent of water for each of these divisions, aud the two superinten dents together with tbe eta.e engineer j constitute a board of control having j general supervision over state waters. Tbeu successors will Le elected in November 1U10. In sny conflict over water ncbts the Loard of control has hret aud immedi ate juiisdictioD, and will proceed to determine tbe relative rights of all water users of the stream ; each One will have tbe right to Le beard and submit evidence. Tbe board in its findings will tn amount pf water to wbicb each user Is entitled aadtbe priority ; and If there be no appeal from Us decision within etx month Its Undines are final and permanent, eliminating further litigation. Tbe board baa tbe power to enforce its 'findings and tbe decrees of the court relative to water rights. This is one of tbe most necessary features of tbe new law. Under tbe old method, after long and expensive litigation bas re sulted in a decree adjudicating rights endless litigation followed attempts to Lave tbe decree euforced. No adjudication of rights will be made by tbe board of coutrol except where complaint s are made by water user. Tbe uew law amply protects all exitsing rights to tbe beneficial use of wate.. It applies to all forms of water use municipal, irrigation, power and domstic. It is not an un tried, experiment piece of legislation. A similar law bas been in force in Wyoming for a number of years and Its operation bas been very fctaiafact ory. Several otber atatee bave water laws wbo&e chief features follow tbe Wyoming measures. Tbe bill proposing tbe new law was opposed only by tbe large power com paoies,but tbeir opposition was iutile in tbe face of tbe strong public seu timent beb-.nd tbe cat. Tbe Senate Irrigation committee, of which Sena tor Merryman, held teveral public meetings tbat were largely attended by representatives from communities .all over tbe state. Seveial persons visit ed Salem tor tbe purpse of opposing tbe bill, but rinding tbat they misap prehended its provisions aud scope stayed to urge its passage. Jt is quiet probable that one ot tbe super lueudeuta w ill b9 appointed from Kiamatb county. Tbe appointment is made by the Governor, aud State En gineer Lewis is very anxious to bave 11. Li. llolgate appointed and bas wired him asking if be woull accept tbe place. There are a numbei of rppli cants from Kaetern Oregon for tbe ap pointment tor tnis d istrict, but it is beieved tbat Mr. llolgate stands tbe best chance aud will likely be ap pointed. Klamath County ia tbe greatest irri gation district in tbe state aud this end of tbe state, iucluding Lake County, bas many important water rights to be adjudicated, and therefore tbis section is justly entitled to the superintendent for tbis district. There is probably no man in tbe state who is better qualified or more famil iar with Ibis question of water rights thai Mr. llolgate. He has made a study of the matter for a number of yeais, aud his connection with the lietlaniatiou Service brought him in close touch witb every phase of Ibis great problem. Tbe position pays $2400 a year and it s not nceessary for tbe officer tc change bis tesidence. Tbe Reno Journal in discussing tbe probability that ilurriman has really purchased the N. C. O narrow gauge, Lakeview's nearest aud only railroad, rightly states that tbis is a rich country and "destined to be the ban ner farming country of the world." As an evidence of this it sites the following instance of what is one ft many cases of the kind: If oue farmer can go into the N. 0. O country with C0 aud a pair of broken down horses to come out 15 years later witb a bank account of 'i'l,OOU, to say untbiug of a fine and healthy family, it looks as though Mr. ilarri rnau might be justified in epeudlug a few hundred thousand dollars bring ing more people into this country where ueighbors are as much 30 miles epait. Roy Vastal, whom Sheriff Barnes, ot Klamath chased all over tbe country, and finally captured in Missouri was sentenced to one year aud three months in tbe penitentiary. It is believed tbat bis conviction and tbat of Wallis and Welch will break up tbe operations of tbe stock rustlers in Klamtath County. Thoae of our readers who suffer can make no mis take in giving it a trial. Tbe Rums Commercial Club is an energetic body. It bas petitioned tbe government for aid in sinking a test artesian well in order to give eettlers some definite basis in sinking sucb wells for irrigation purposes It is a good idea.
