TAIN POINT. FOR PROVIDED ALL COMPETITION IS NOT D
STROYED IT ENCOURAGES THE CONSOLIDATION OF COMPITINO
CORPORATIONS UP TO A CERTAIN POINT, BECAUSE THEY CAN
DO LEGALLY THEN AS A CORPORATION WHAT WOULD BE IL
LEGAL AND CRIMINAL IF DONE AS SEPARATE CORPORATIONS
UNDER A TRADE AGREEMENT. THE VERY EFFECT OF THAT
LAW HAS BEEN TO ENCOURAGE THE MORE RAPID CRUSHING
OUT OF COMPETITION IN THIS COUNTRY.
If HEAL l'llOCKKSS is to be made toward the solution of the
rexed industrial problem, which confront the nation, this law should"
be amended so as to clearly define what shall constitute illegality ia
trade agreements.

I HAVE NOTICEO A GOOD MANY COMPLAINTS THAT CRIMI
NAL PROSECUTIONS AGAINST TRUST MAGNATES AND SEN
TENCES OF IMPRISONMENT FOR THEM HAVE BEEN VERY
INFREQUENT AND, IN FACT, FOR PRACTICAL PURPOSES
UNKNOWN. IT IS PERFECTLY TRUE THAT, IN MY
OPINION AT LEAST, A BETTER MORAL EFFECT WOULD BE
PRODUCED BY SENDING A FEW PROMINENT MEN TO JAIL THAN
BY A GREAT DEAL OF LITIGATION, HOWEVER SUCCESSFUL,
AGAINST THE CORPORATIONS THEY CONTROLLED.
Hut it must be remembered that it is only SUCCESSFUL prose
cutions which would have a good effect. Some time since two corpora
tions And their renpcctiv presidents were indicted jointly for viola
tion of tlio criminal provisions of the antitrust law. If the corpora
tions wore guilty of such, it would be hard for the lay mind at least
to undcr!.:iid how their presidents could b innocent. Nevertheless

It is ti.e avowed purpono of the department of justice to prose
cute criminally any one who is really responsible for violations of the
antitrust law wherever it can do so with any REASONABLE proba

are known to every one to have acted under the direct authority of
their supriors.

JIo hears a lot of glittering generalities about the law treating all men
Alike. It does treat all poor men alike, and it does treat all rich men
alike, but it treats the rich far differently from tho man without
money.

YOU AND If THE ONE THING TO DO IS TO PUT THE GUILTY
OFFICERS IN JAIL. THAT MIGHT PERHAPS INDUCE THEM TO
HAVE SOME REGARD FOR THE LAW AND ORDER.
