This ruling ia in com fortuity with the department's policy In giving settlers an opportunity to settle npon lands released from with drawals over ecrippers and timber land seekers.- There is a possibility, lowever, that in favoring the home seeker the department has still left a Uoophole through which the timber Jands may be secured by s.-eculators, ia not restricting the homestead . applicant to a homestead iiling alone, j on the same tract of land. In order i to profit by the leniency of the ruling, it is troe, perjury must be committ- ed, and be who is caught at it must .look tor punishment. Under the present ruling a person may go upou a tract of land on September 28th and begin settlement. On October 28, be can file a homestead on the ground of prior occupation. After the smoke has settled he may thee re'inquish bis homestead flliugs and file a timber and stone claim, which does not re quire residence upon the land for five years to gain title. Numerous contests are likely to follow, and it la to be hoped that he who seeks the "land in good faith will win out Ed Howell and hi nn. Ed. Howell, the Pine Creek mining man, was up town Monday on a bust nesa trip Mr. Howell has put in two years steady at the mines working his claims. Helsdes numerous pros pect boles, be has two tunnels, each about 125 feet In the bill. He expects to strike tbe ledge within the next hundred feet, over 100 feet down from the surface. He has absolute faith in finding something worth digg ing for when be strikes the main lead. His description of tbe country aud the formation of tbe rock he has tun neled through compares very favorably with tbe description and analysis of formation in tbe richest miues knowu of today. He says be has compared descriptions with the noted Cobalt mines also with the Ooldfleld mines, and in his belief the formation is tbe same, only that be has what h calls tbe porphyry in oiiginal state, some thing the former miues do not pro fess to possess. Mr. Howell has not said very much about hia prospect before, in fact be has not taken the time to talk, having been busy dig ging. If there is a mine in tbe dis trict he certainly will find it, if be is in tbe right location, and in this fact be has the greatest confidence. Sawyer, of Portlaud, connected with tbe U. S. Immigration Bureau, arrived in Lakeview Monday for the puroose of investigating the application of "Tom" the laundryman for tbe admittance of his son to the United States. Winslow Bailey pre pared tbe papers for the admittance of the Chinese boy upon tbe affidavit of residents of Lakeview. To admit Tom's son to tbe United States it is necessary to show that he is not of the Cooly class, and we understand that the affidavits show that Tom is a merchant. Mr. Sawyer called aud examined witnesses in this case Tues day, and took tbe testimony. He will not decide tbe case until after bis re turn to Portland. In substance, tbe fate of the young Chinese boy rests npon tbe showing mado at this trial Tuesday substantiating the affidavits that China Tom is a merchant. Tom is a good Chinaman, bonest, in dustrious aud everybody likes bim, and would be glad to see bim have his hoy witn bim. Hut no one wants to see the laws of the United States violated for the gratification of Tom, or even those who like bim,. This is a matter that must be decided wholly upon tbe law, as the bouor of Lake viwe is at stake as well as tbe welfare of our country, and Mi. Sawyer will rule according to law.
