Arguments for a new trial In the broach of promise case of Birdie, Me Carty against J. Ii. Heryford have been heard by United States District Judge Bellinger, Portland. Miss Me Carty sued Heryford for 75,0OO for having trilled with her affections and obtained Judgement for $2'J,.r00. The motion for a new trial Is based upon an affidavit of Mrs. Fitch, the proprietress of the hotel at Bly, who denies Miss MeCarty's statement that she and Heryford stayed lit the house ami had occupied a single room.
