THE QUARANTINE SHEEP LAW. Duties of The 5tock Inspector And Penalties For Non-Performance Of Duties Under This Act In The State Of Oregon Duties Of Owners. Fevtion 2. Any tcii, cotnjany or corpor ation violating the .proviMon" of tin. section, chall le deemed guilty of a tni demeanor, and upon conviction thereof shall l punished ly a tine of not leva than fifty nor more than five hundred dollars, and any party injured or dam aged hy reason of the movjni of aaid sheep, "hall be entitle! to recover off of aid person, company or corporation, by civil action, three times the amount of damages, direct or consequential, that aid party has actually sustained by reason thereof. Section 3. That section 3353 of the laws of Oregon, as compiled and anno tated by Wiiliam Lair Hill, be and the Mime is hereby amended so as to rend as follow s : 4 3353. Whenever, upon examination of any herds or bunds of sheep, kept or herded within any roiintv of the State of Oregon, the Stock Inspector of such county shall find such bund or herd of heep. or any portion of them, infected nth scab or ccabhiea, or any contagious or infectious disease, it shall be his duty forthwith to take charge of su. h herd or band of sheep and keep the same from contact with other sheep until he has cured them of such contagious or i n fee-1 lioue disease, giving notice in writing to J the owner or person in charge of sii .-h herd or bund of infected sheep that he haw ho taken possession, the reason there for, and the place where audi sheep hall be kept until cured of the disease with which they may be infected. Im mediately Uhjii taking possesnen of any Land or herd of sheep a-s provided in the foregoing section, the Inspector shall proceed to aiplv to such infejted band ir herd of sheep proper remedies for the cure of the disease of which such sheep may be infected. If said sheep are in fected with scat) or scabbies, he shall, within fifteen (lavs from the date of taking possession of such sheep, thor-' oughiy dip said sheep with a dip of recognized virtue in the cure of such disease, such dip to be selected by the Inspector and applied under his direc tion ; and he shall thereafter, at least once and as many more times as nay be necessary to effect a cure of said disease, dip eaid sheep thoroughly as provided in tbia section with an interval between the dippings of not less than twelve nor more than seventeen days. And w hen cored of such infectious disease, the In spector shall so notify the owner or per son in possession thereof at the time the Inspector took possession of such dis eased sheep. Such Inspector shall then quarantine all the corrals, pastures and ranges in which they have been confined or herded upon since, they were first dis covered to be affected with each con tagious disase, by closing such corrals, and posting a notice thereon warning the public of the infection therein, and to refrain from occupying such corrals with bands or herds of sheep for a period of not less than three nor more than Bine months, under penalty as herein after secified, and by posting two no tices in two conspicuous places upon such range or pasture, warning the pub lic of the infection thereon, and to re frain from pasturing or herding thereon for a period of not less than thirty nor more than ninety days thereafter, under penalty as hereinafter specified. Any person or persons who shall con fine any sheep in any corral or pasture or herd upon any range while under quarantine, shall be deemed guilty of a misdemeanor, and upon conviction there of shall he punhhed hy a fine of not less than fifty nor more than two hundred and fifty dollars. All excuses incurred fiy the Stock Insrector in the perform auceof his ollicial duties, as above speci fied, including the expenses incurred in taking possession of any infected band of sheeo, the care of the same, tho rem edies used and the exjtense of applying the same, the wages of assistants em ployed, compensation to said Inspectorj at the rate of three dollars ($3.00; per' day for such dny or purl thereof in which he inay In engaged in attending to the ilippii g of such thocp, shall Uvome a lien upon si. id sheep, and the Inspector shall hold the sheep until the same paid; or if it lie not jmid within ten days alter notice of cure of said disease as herein provided, the Inspector may, after ten ihtvs' advertisement thereof in some newspaper of general circulation in the loutity wherein such sheep are, proceed to sell such sheep, or as many thereof as may be neve sary, in the manner provided by law for the sale of personal property under exetution, and from the proceeds of such sale he shall pay all eharges incurred under the terms of this act, together with the exenses of advertising and sale of such sheep, and shall render the surplus, if any, to the owner or person in lawlul (Misses ion of such sheep, taking Ins receipt therefor, for any and all sheep returned to him after such sale. Stock Inspectors, in enforcing this act, shall take into consideration the con dition of the weather, the lambing period of sheep, and shall otiserve the conditions thereof as follows: He shall not dip any band or herd of sheep, or any part thereof, when the weather is of such severity as to endanger the lives of the same by so dipping; he shall not dip any band of ewes, or any part of them in which there are ewes with Intnl.", at any ime from the tist of March to thr first of May of any year; that in Lake county be shall not dip any ewes with lambs, frtmi the first day of April to the first day of June. Kelwecn the first day of January and the first day of May in each year, all sheep lieing then west of the Cascade range of mountains in Oregon shall be exempt from the provisions of this act. Any Stock Inspector, who, having taken into his possession any hand or herd of sheep as by this act provided, shall by gross negligence or malfeasance in otlice cause the owner or owners thereof to sustain ilmnaue, shall tie, together with his sure ties, lial le for all damages sustained by reason of such gross negligence r mal feasance in office, together with all costs in collecting the same, which shall be recovered in a civil action beiore any court having jurisdiction thereof, and the proceedings shall be the same in all respects as in other civil actions. Section 4. That section 3354 he amend ed so as to read as follows: $ 3354. The Stock Inspector of the several counties of this S.ato shall re ceive the following annual salaries for their services, to be paid quarterly by their respective counties, tie wit: Of Baker county, four hundred dollars; of Benton county, twenty-tivo dollars; of Catsop county, twenty-five dollars; of Coos county, twenty-five dollars; of Columbia county, twenty five dollars ; of Crook county, eight hundred dollars ; of Curry county, two hundred dollars; of Douglas county, one hundred dollars; of Gilliam county, five hundred dollars; of Grant county, eight hundred dollars ; of Harney county, three hundred and fifty dollars; of Jackson county, two hundred dollars; of Josephine county, twenty-five dollars; of Klamath county, one hundred dollars; of Lake county, eight hundred dollars; of Lane county, twenty-five dollars; of Linn county, twenty-five dollars; of Marion county, twenty-five dollars ; of Morrow county, eight hundred dollars ; of Multnomah county, twenty-five dollars; of Malheur county, five hundred, dollars ; of Polk county, twenty-five dollars; of Sherman county, three hundred dollars; of Tilla mook county, twenty-five dollars; of Umatilla county, four hundred dollars; of Union county, eight hundred dollars; of Wasco county, eight hundred dollars ; of Wallowa county, three hundred dol lars; of Washington county, twenty-five dollars; of Yamhill county, twenty-five dollars; but the County Courts of the respective counties may, in their dis cretion, when sitting for the transaction of county business, increase or decrease the salaries of such Inspectors in their respective counties. The Inspectors shall also be allowed to collect a fee of three dollars per day for every day or part of a day in which he shall be en gaged in inspecting sheep for the pur pose of granting traveling iiermits or certificates of soundness, together with ten cents per mile for the distance neces sarily traveled by him in making such inspections except at senii-anuiial in spections; provided, that no jierson, company or corporation owning or con trolling any band or bands of sheep and holding a certificate of soundness issued by the Inspector of the proper county within thirty days of such lime as such erson, company or corporation shall desire to move said band or bands of sheep, shall be required to have a traveling Hrmit for the pnrise of mov ing said sheep from one hvality to an other withiu the county in which such sheep are located. Any Inspector at any time granting a permit to allow any stock to travel without first having ex amined said stock, shall be deemed guilty of a misdemeanor, and upon con viction thereof shall he punished by a tine of not less than one hundred dol lars nor more than two hundred and fifty dollars ; and for any violation or a failure on the part of any Insector of stock to comply with any of the require metits of this act, it is hereby made the duly of the resn-tive District Attorney of the counties where such insicctor mav reside to forthwith institute, in the name of the Mate of Oregon, action upon his official IhiiiiI against said In spector and his sureties for the enforce ment therein provided for. .
