QUESTION — I started to
build a duplex in 1964 but was
unable to complete it because
of city sewer requirements

ture and appraised it as a
minimum home, and not as a
duplex. I maintain that I am
building a duplex and not a
cabin and I have applied for
an exemption on this property
under ORS 307 330, which
grants an exemption to com
mercial facilities under con
struction. under certain condi
tions Based on the above facts

the only question is whether
the building was still in the
process of construction on Jan.
1. 1970 Since all requirements
