To interfere with visitation rights is punishable as con tempt of court. A mother who secretly moved her children to another state to keep the fath er fr.m visiting them was held in contempt of court. The court grants visitation rights only to the parents. These rights do not go to other relatives. In a recent case the court awarded custody f a child to his father. The child liecame ill and incurred many medical bills. The court ordered the mother, who was wealthy, to make support payment for the child. Her failure to pay violat ed the court’s order. The courts expect that the parents, although divorced, will make every effort to avoid conflicts that will affect the children. (Oregon lawyers offer this column as a public service. No person should apply or inter pret any law without the aid of an attorney who is complete ly advised of the facts involv ed. Even a slight variance in fact may change the applica tion of the law.) When parents divorce, the courts “award” children to the parent whom the judge be lieves can take the best care of them. In deciding, the judge considers the child’s age, the parent’s ability, the child’s preference, and other factors. The court will not a- ward a child to an “unfit” par ent. In rare instances, the court may award a child ti someone besides a parent, per haps another relative or to an institution. The parent who does not have custody can visit his child as a matter of law. A court may detail his visitation rights, but any limits should be “reasonable.” In unusual cases the judge may retract these rights. In one case a court denied a fath er the right to visit his son because a court had convicted him of non-support. Besides, he had threatened to take the child out of the state. When a parent is denied vis itation rights by the other parent, or has them limited by the court, he still has the legal duty to continue to sup port the child. But just because the parents live far apart does not bar a child from visiting his parent.
