Parking Lot Accident
Mrs. Jones parked her car
in the supermarket parking
lot while she shopped. When
she returned, she found that
someone had backed into the
side of her car, causing consid­
erable damage. The other driv­
er had left without leaving
his name.
Fortunately, another shop­
per witnessed the accident
and informed Mrs. Jones of
the license number of the oth­
er car. What can Mrs. Jones
do about it?
The police usually will not
make an accident report, or
issue a traffic citation occur-
ing on private property.
The Motor Vehicle Code—
which sets forth the rules of
the road—applies only to the
operation of motor vehicles
public streets and highways,
it does not apply to accidents
on private property, such as
a store’s parking lot.
The police were glad, how­
ever, to obtain ownership of
the offender’s car from the
license number and tell Mrs.
Jones, so she could pursue her
own remedies.
Even though the rules of
the road do not apply off the
street, the common law rules
of negligence do. Thus, any­
one who negligently causes in­
jury or damage to another
can be held civilly responsi­
ble for the damages. In this
case, Mrs. Jones has a cause
of action against the other
person, and should be able to
collect for the damage to her
car.
Also, remember that the lia­
bility insurance carried by
most vehicle owners DOES
cover accidents both on and
off the highway. Here the
other car owner’s insurance
company would probably cov­
er the damage to Mrs. Jone’s
car.
