CHAPMAN AGAIN Circuit Judge Phelps, of Pendleton, assigned here from Umatilla county to hear the case, has notified City Attor ney E. C. Smith of a decision favorable to the defendant city in the case of E. E. Chapman, who was seeking to re strain the city from opening a street over his Columbia lowland property, connecting the Columbia at low water period with city streets. Mr. Chap man contended that the city was trying to turn a portion of a navigable stream into a street, but the city asserted that the property condemned last year as submerged only during the period of high water. The city opened the street both to give passage to vehicles to and from the Underwood, Wash., ferry system during period of low water and to provide a landing place for ferry boats during high water.
