BARTMESS finial mm and mm mm HOOD RIVER, OREGON At tha instigation of citizens of the Heights, who appeared before the city council Monday night, the fire and eater comittee of that body was given power to act in the improvement of the water system on the Heights. E. M. Holman and other Heights citiaens were present at the meeting of the city fathers and testified that one of tl.e old wooden mains in that section of the city had become so decayed that the water was made to taste of the rotting pipe. City Engineer Morse stated that the pipe had so decayed that it ahould be improved. He estimated the coat of the proposed improvement, includ ing labor, at $450. Mr. Morse declared that the city would save money by hav ing the work dune at once, and this suggestion was seconded by Council man Franz, who declared that at least 15 per cent could be saved by purchas ing at the present time, the materials needed for the work. The petition of Gilbert Edging ton, signed by numerous Heights citizens and asking that Mr. Edgington be ap pointed as night policeman for the Heights district, was not received fa vorably by the council. The petition was referred to the police committee, where it will no doubt be turned down. City Attorney Wilbur submitted to the council a letter received from at torneys of W. Margulis in Portland. The attorneys asked for an arbitration of alleged damage caused to Mr. Mar gulis' place by.the contsruction of the main of the city water system. Mr. Wilbur, however, read the provisions of the deed of right of wsy made by Mr. Margulis, the provisions of the deed calling for an arbitration'only in the case of injury to fruit trees. It appears that Mr. Margulis is claiming damage from leakage from the pipes. City agents have made an investiga tion, and it is alleged that the water said to cause damage does not come from the pipes but that it is natural seepage of the land. Mr. Wilbur sug gested to the council that the proposal of arbitration be.refused, and the body so instructed him to answer Mr. Mar gulis attorneys. The judiciary committee of the coun cil was given power to act in the case of the trespass of the wharf of the People's Navigation Co., a portion of the building having! been erected on city street property extending to the water front. The wharf house has be come known as Jack Bagley's bunga low, Mr. Bagley being the Iocs! repre sentative of the tiver boat company. An ordinance calling for the sale of a bond issue for the improvement of Eleventh street between Sherman av enue and Eugene street was.read the first time. COL TUCKER MAY YET BE REINSTATED Despite the fact Col. W. F. Tucker, former assistant paymaster general of the United States Army, who was re tired because of serious illness in 1909, failed to pass the recent examination st Vancouver barracks, he declares that he would not be surprised to be rein stated to active duty after the report of the examining board is turned in and passed on by the surgeon general of the army. . "I am led to believe," says Col. Tucker, "that when the report goes in to headquarters and goes to the surgeon general he will find that I am about as normal as any man of the age of 63 years. Out of about 300 retired officers who were to have been examined re ports on but about 15, according to the Army and Navy Journal, have been turned in. The Secretary of War will issue no orders and make no reports until all of the reports have been filed and passed on. "The test 1 took would have been a rigorous one for a man of 21, and my failure to pass it does not by any means preclude the possibility of my being called to active duty. "Whether 1 shall be called or not, I am going right ahead maintaining my good health on my Upper Valley farm, El Corregidor, whither my wife and 1 came as soon as the Vancouver tests were over. If the United States should get into war I will be ready for any call that may be made of me, and I will be found with health such as can only be gained in Oregon climate." 51st Wedding Anniversary Celebrated In celebration of their 51st wedding anniversary, members of Csnby Post. G. A. R., and the Woman's Relief Corps' gave a surprise party Monday after noon to Mr. and Mrs. T. E. Kellogg is 78 years of age, while his bride of more than a half century ago is 74. Their wedding occurred in Stevenson county, 111. Mr. and Mrs. Kellogg have three children, two boys and a girl. Ihey are Harry and Arthur Kellogg, of this city, and Mrs. Cecil Ayers, of Walla Walla, Wash. During the Civil war Mr. Kellogg served in Company E of the Thirty sixth Illinois regiment. He was with Generals Grant, Sherman and Thomas in succession. HEIGHTS NEWS Mr. and Mrs. T. E. Kellogg, residing on Eighth street, were very happily surprised on Monday afternoon by quite a number of Relief Corps ladies and Comrades from the Post, the occasion being their 61st wedding anniversary. Mr. Kellogg is a member of the Post. The ladies took them some yellow chrysanthemums and after a delicious lunch, Mr. and Mrs. Kellogg were pre sented with a gold piece by the presi dent of the Corps, Mrs. L. M. Bentley. They were much pleased to have their friends meet with them in such a social way, as they are neither able to get out very much. Mrs. Kellogg received rather a severe fall Sunday, but was feeling much better Monday. Rev. W. S. Nichol returned home last week and a friend. Rev. Allen,. came with bim. Mr. Allen wishes to bring his family and live in the west. He is looking for a place where he may have charge of church work. Tom Fisher left for Pittsburg, Penn., last Sunday to visit his wite and fam ily. He his been here for several years. Two daughters, Misses Lillie and Myrtle Fisher.remain here.
