Tbia makea tbe disiauoe 9f milea and allow out; two milea over tbe old trail for grades aud extra turns winch might be made with tbe road. He says tbat be thinks tbe average road would be open a little work by June 1, of each yea i. 1 crossed the divide over tbe Hunger's trail July 12, 1908, aud rode through six feet of enow. He aaya. "1 don't tbink tbe U. Tbe Uovernmeut and its agents sre tbe empoyeea oi tbe people and not tbeir masters.'' In auswer to this, 1 will simply give the aot in full, (which 1 referred to in your isfcue of December &). " An Aot Kor The Protect ion of tbe Hull Kun forest Kesetve And lbs Sources Of Tbe Water Supply ot tbe City of Portland, State ot Ore gon ; be it enaoted by tbe Senate and tbe House of Kepreseutatlves cf tbe United States of America, in Con gres assembled, That from aud after tbe date of tbe passage of this Aot it eball te unlawful tor any person or persona except forest rangers and otber peraoue employed by tbe United States to protect tbe forest, and Federal aud State cilioera in toe discharge of their duties aud tbe employees ot tbe water borad of tbe City of Poii; ami, State ot Uiegon, to enter, for tbe purpose of grazing stock, upon any pait of the reserve known as tbe Hull Kun Forest Keaeive, in tbe Cusoade Mountains in tbe State ot Oregon, wbicb reserve was established by proclamation ot tie Piesident of tbe United States in eigtbeen hundred and ninety two waa piovided by Section twenty our ot an aot of Congie's entitled, "An Act to repei.l timhei ool'iter laws aud for other purposes," approved March third, eighteen hundred and ninety one, and which leserve includes within its area tbe water supply of tbe oity ot Portland, State of Oregon and any person or persons, save those heielnbdtoie excepted, who shall engage in grazing stock, or who shall permit stock ot auy kind to graze within said Hull Kun forest He res, or who ab-ill ku. wingiy tiespass thereon, sbt.il be deemed guilty ot a misdemeaut r, and 00 conviction thereof in tbe district court ot the United States, for tbe district of Oie goo, shall be lined uut to exoted rive hundred dollars, in tbe discretion of tbe court. Aa to tbe government and ita agents being the employees ot the peo ple and not their master, tbe Govern ment Is the people and not ita em plo ees. the agents of tba people are tbuir employees, of course. As to tbe expense of the Columbia Iliver road, 1 did not undertake to itemize tbe cost of either road, oot merely tried to show tbat the Liost Lake road waa a longer and more dittiuult grade, and would also be a short season road and wben you con st ler building a msordamlzed road for fast travel, there is no comparison between the two With tbe Columbia Kiver road you build ainund the base ot the Cascade Mountains and not over the summit. As to distauoe, he says, "Let us consider where we're at." Tbe W. M , passes through Portland, as does also the Base Line. All right Ibe town of Hood Kiver is not far from tba oornerSof the T K 10 K. Acroaa each township is a diatanoe ot 6 miles. Therefore by a dnect survey Hood Kiver ia tiO mio east and 12 miles north of Portland, 72 miles. Now, tbe Coin! mi Kivei road is juat lift milea hy correct measurement, taking tbe distanoe at right auglea ani following a dlrot course irom the N. K Cor. of I 2 N, K 10 B to tbe connecting points of tbe Base Line and the W. M , or Portland. Mi. v. hi us acknowledges tbat his route uaniee biiu two aud oue hslf Mies south of tbe Base Line; but by fohow lug tne Sandy route, wbiob we both reterieed to, you pass with in a tew rods ot tbe sooth side of T. S S , K. 7 B. , making it 12 milea south of tba Base Line by a direct course. It Hood uiver Is 60 milea eaat of Portland and 12 milea south ot .the Base Liue and having to return again. Y'et, be aaya, by suivey, tbe Lioat Lake route will prove tbe shortest; but any one oao see at a glance tbat you can't reach Portland on an air line via Lost Lake inside a distance ot w miles. Now, concerning the direct route he refers to from Lost Lake to Port land, 1 would like to give a few eleva tiona taken from the U. S. Oeologiosi Survey mnp, hegiouing where tbe road croaaea thn West 1'ork of Hood Kiver, and ending at Aims, on tbe old Multouomah Couoty toad. West Fork ot Hood Kiver aud wagon road, 2007 feet; where the road passes around the base of Lost Lake Butte, 3211 feet ; Lost Lake 314 ; so from tbe West I'ork to Lust Lake Butte you climb 1207 'feet, then dropping down to Lost Lake trom Loat Lake, Huc-)tleberry Mountain mile, 3902 feet; divide ridge, 4012 feel; Bull Kun Lake, '..mile, 3000 leet; 1 mile 4201 fee' ; 2 mies, 3500 feet; mile, 2300 feet; wheie this line crosses tin Bull Kun Kiver 1000 feet; Walker Prairie, 1955 feet; Alms, 1104 feet. Tbia will give you some idea of what kind of a country this toute ia to build a road tbiough. Ibe only way to avoid this uneven ground is to follow soma water course. There are but two main streams wbioh could be followed to advantage fiom tbat divide. The Hull Kun Kiver, wbicb would be the sbor est, but 1 beiiive an impossible route. It woull u o -sitate climbing the divide bttweeu Bull Kun aud Loat Lakes. The other is to follow uptbe West Fore: of Hood Kiver, keeping east of Lost Lake Butte, up hlk Creek to tbe divide, thence dowo tbe Clear Fork to Ita mouth, and down tbe Sandy Kiver to the Barlow Koad, tbe course wbich 1 deoaiibed in tbe first part of this article. That would take you aoross tbe divide 5 miles eouth ot Lost Lake, by tbe survey at an elevation of 3500 teet Tbia route, as 1 said in the Brat plaoe would make the dis tanoe ot nearly 100 milea. Aa to tbe oonditiou of this road from Lost Lake to Winan and trom Clear Fork to Bar tow Koad, wbiob is in about tbe same condition ns tbe Lost Lake road, I am reminded of what an old aettlei 'n Hood Kiver said, "You oan hardly drag a pack horse over it, let alone run an automobile."
