seems to be little objection to it ou
the part of growers or shippers, while
all operators are aaturally in favor It.

effect next year"
The bill reads as follows :
Section 1. That the provisions ot
this act shall apply to closed puck
ages of upples that are, or may be,
transported from one state or terri
tory of the United States, or tbe Dis
trict of Columbia, to another state or
territory to another place in the
United States to au adjacent foreigu
country, or from any place in tbe
United States through a foreign couu
try to any other pluoo in the United
States.
Seo. i. 'X'but iu this act, unless the
oontext otherwise requires the expres
sion "closed package" meuiis a barrel,
box or bnsket, of which the contents
cannot readily be seen or inspected
when suuh package is prepared for
market.
Apples packed iu closed orates, bur
tela or boxes, covered with slut cov
ers, burlap or tarlutau, snail come
within tbe meauing of the expression
"closed packages."
Sec. 3 T'huf in this not tho follow
ing classifications for closed paokuges
of apples shull be adopted as standard
packages :
The Ntandard measure for capacity
for all tipples packed in boxes shall be
the heaped uushel, containing as near
ly as may be 2,501 oubic iuobes, and
of no less capacity than would ho con-
ained in a box of tho foiling dimen
sions: 18Js by 12 by 11 inches, in
side, measurement. Boxes of the
above described capacity or dimen
sions shall be marked "standard."
Any box of less dimensions or capa
city shall be marked iu a plain uud
indelible manner, both ou sido and
top, iu lutters not less than ouo inch
long, "short box" or with tho frac
tional part of a bushel it may contain.
Puit 2. The ttsndard measure of
capacity for all apples pucked In bas
kets shall be the heaped bushel, con
tAiniug 2,504 cutio inches.
Baskets of tho above desciibed ca
pacity shall bo muiked "standard bas
ket." Auy basket of lesB capaoity
shall be marked In a plain aud indell
bla manner on both tide and top, in
letters not le.;s thsn one Inch long
"shoit bushel" or with the fractional
port it may contain.
Part The standard measure of
capacity for all apples packed lu bar
rels shall be as nearly us may be, three
bushels, the barrel to be of no less
dimensions than 17' inch head,
length of stave 28 'j Inches, with bulge
circumference noteless than 01 inches

That iu this act tbe following class
ifications of grades for closed pack
ages of upples shall bo adoptel as
standard grades. "No. 1" and "No.
2 but such mark may be accompa
nied by any other designation of grade
or brand, provided that such desig
nation of grade or brand is not incon
sistent with or marked more conspicu
ously thuu tbe one of the said two
marks designating grade which is used
ou tbe package.
Pa;t 1. "No 1" giade and quulity
shall consist of healtby, well grown
apples of one variety, souud, of not
less than 2.'3 iuohcslu diameter and of
good cjlor for the variety, ot normal
shape aud not lss than 90 per contum
tree from scab, worm boles, bruises
and other defects, and propeily packed.
Part 2. "No 2. " grade and quality
sbill consist of apples ot not less than
nearly medium size for tho variety,
healthy, and not less than 85 per cent
free from scab, worm holes, bruises
aud such other detects as cause mater
ial waste, and properly packed.
Seo. 5, That tbe enforcement of
this act shall be under the direction
of tbe Department of Agriculture, of
the United States, and the Secretary
of Agrioulture shall appoint a green
fruit oommissiouer (with a eufllolent
apropriation to carry Into e fleet tbe
piovisious of this act), Hud to employ
such assiotants as may be necessary.
Sec. 0. That it shull be tbe duty ot
the suid green fruit commissioner, up
on the reasonable request of any per-
sou, o. rporatlon or lirm, navlug In
their possession, and intended for In
terstate Commerce, apples in closed
packages, as heretofore described,
and to such person, corporation or
Htm making such request, a certifi
cate which shall Bet forth the grade
or stui.dard of apples aud package as
et-tahtisbed by this act, aud if suid
inspector shall Uud the apples proper
ly packed, according tj the standuid
set forth in this act, he may certify
to the same or it he duds tnetn packed
or graded inferior, or not true to
matks, it shall be bis duty to mark
them iu a plain aud indelible manual
"falsely marked."
For the services outlined ou this
sectiou a reasonable charge may be
established; said charge not to exceed
live (fio. ) cents per barrel, and two
and one-halt (2,.jc. ) cents per barrel
box or basket; provided that the
minimum total charge for such ser
vices shall be two dollars and fifty
oeuts (i2.50).
Seo. 7. That every person who,
not being an authorized government
iuspeotor, willfully alters, etfaces or
obliterates wholly or practically any
ot the murks prescribed in this act
for "cloa d packages" of apples, or
causes the same to be doue, shall be
liable to a fine ct not less than twenty
Ute (25o. ) cunts, aud not more than
hVe (Jj.UO) dollars tor each package
upou which tbe marks have been so
altered, ellaoed or obliterated; and
further,
That every person, corporation or
llrui, who shall be found guilty of
having, either personally or through
tho ugency ot otheis, willfully mis
murked closed packages of apples
as to capacity ot package, as described
aud provided for iu this act, shall,
upon conviction, be subjeoted to a
fine of not less than twenty-five cents
(25o. 1 centB, and uot more thun five
(!?,. 00) dollars for each package so
mlsmurked.

apples are packed, sold or olieied tor
sale, shall be prima facie liable for
tho violation of this act.
See. 8. Thut any of the Cirouit
Courts cf the United Stutes within
whose jurisdiction a complaint as to
tho violation of this aot may be estab
lished, shull huvo power to onforce
his act.
$21,000 FIRE
AT THE DALLES
A disastious lire ocoured at Hun; &
Roberts1 store Sunday morning at
1 :30 o'clock. The tire originated over
the old hall way used as tbe fish de
partment about midway between the
upper stagiug aud the tin roof, where
52 crates of matches and other light
material lu crates sod - boxes were
stored. Tho probable cause of igni
tiou was spontaneous combustion due
to the extreme lieut. Saturday, says
tho Chronicle, Mr. Hunt and several
employes were arranging to move
these materials to h tufer place, as he
was nf raid of a Ore because of their
close proximity to tbe roof, being a
dHugerotiB place during hot weather.
Harry Tuylor aud one of the police
men, with several other men were
standing ou Second street talking
Sunday morning at one o'clock, when
an explosion occured. They rushed
up the street, thinking it was a gun
shot they heard, when they saw the
blaze. Policeman John Crate at once
turned iu the alarm and it was but a
short time uutill the Are department
responded to the call with three hose
carts end tho book and ladder wagon.

Commission Completes Its Work
of
Dividing Funds After Much
Tedioni Work.
After considerable tedious work.
County Judge Derby, of Hood River
and County Judge Lake, of Wasco,
as commissioners, have agreed oo the
prcpoition of moneys which the new
county is entilted to nnder tbe law
providing for the creation of new
county. Chas. 11. Sproat, of Hood
River, was named as one ot tbe com
missioners iu tbe bill creating the
oounty to serve in (bis capacity, bat
refused to act and Mr. Derby wee
appointed by tbe governor to serre in
bis place.
Tbe settlement waa finally agreed
upon last Wednesday and will give
tbe new oounty a sum from the vari
ous funds in tbe neighborhood of
112,000. The agreement to the
amount which Hood River oounty le
to receive was reached without any
friction and tbe lelattoas of the com
missioners were amicable throughout
the transaction.
As ite share of tbe county oouit
bouse propeity tbe new county will
receive 12,014 iq cash and also about
12,000 in cash from tbe general fund.
These amounts will constitute tbe
general fund of tbe new county and
will become available immediately.
From tbe general road fund It will
receive ,12,130.80, and t2.334.40 will
be turned over to Hood River oounty
from Wasco, from tbe oounty school
fund. It will also receive 1334.31
from the library fand ;.tl9.00 from the
lastltute fund; 123.00 from tbe indem
nity fund and 12,103.34 from tbe apeo
ial school tax fond.
There is still unpaid on the 1907 tax
roll an amount approximating 110,000
wbiob when collected will probably
give tbe new oounty 13,000 to be
added to its general fund.
In the settlement tbe state tax due
from tbe new oounty wai deducted
aud paid over to tbe state.
It waa tbe duty also.ot the commis
sioners to pass judgment on several
minor transactions in settling op the
attain ot the two counties that are
not ot any particular interest and
would require laborious details.
It ia expected that tbe settlement
will prove eatlstaotory to tbe people
of both counties as it is to the com
missioners, one of whom stated at tbe
conclusion of tbe work: "You may
say for as that tbe settlement has
been made to the satisfaction of the
commission appointed by the gov
ernor to do the work, and that though
tbe work progressed slowly, owing to
the necessity of tiaolng op aooounts
in the records, when completed it
represents the due quota of both Hood
Kiver and Wasco oounty as nearly as
we could get at it. We trust the work
will prove satisfactory, as we were
particularly careful that each oounty
should reoeive its just proportion of
the funds."
Tbe books were in tbe safe and tbe
bills which were made out were saved.
Tbe fire fiend seems to have liking
for this store, for about two years ago
a blaze started In about the same
place when conducted by Bonn Bros.
Tbe tire department worked like
Trojans, and are deserving ot great
praise for their work. All banda were
steady and beads oool iu handling the
bose, usiug good judgement in their
work throughout. Tbe fire broke out
afresh at 3:30 making tbe brightest
light any time during tbe blaze.

erts amounted to $21,000, and tbe loss
was total. The amount of insurance
curried cannot be told aoourately un
til Mi. Hunt oan set at his books.
Mewton Clark Resigns Ofllce.
Newton Clarke, for many years a
resident ot Hood River and father of
W. L. Culrk, tendered his resignation
as Urand Reoorder ot the A. O. U. W.
this week. Mr. Clark ,whoas inter
viewed by tbe Telegram Monday in
regard to bis resignation said:
"I am getting too old to serve
longer," Mr. Clarke said today. "1
am in my 71st year and I shall retire
from active life for tbe remainder of
my years. I have been grand reoord
er for 20 years now, and I think I
have a right to rest.
"Tbe order is in the most prosper
ous condition of its existenoe, though
there was a time when it had about
double tbe number of its present
membership, which is a little ever
4000. A few years ago, we were
obliged to raise tbe rates to provide a
surplus to draw upon as our order
advanced in years, and that raise had
tbe effect of driving a number ot our
young members out. Tbe old ones
stayed, however, and we are getting a
good proportion of young ones in at
present, though little work has been
oue in soliciting. We have more than
100,000 on band and we meet our
death losses instantly."
