er the 4uin of $90,000 damages, be
oh u no of an alleged oar shortage, up
on the part of the railroad company
wblob entailed heavy loses upon the
part of the shippers.
As we view tbe importance of this
case it is not with referenoe to tbe
few thousand dollars wblob may be
won or lout, but it will establish
precedent which will practloally de
tide '.ho question of tbe liability of
common carrier and tbe rights of
shippers.
If tbe case should be deoided in fa
vor of tbe plaintiffs it is very proba
ble that many similar suits will be
filed agaiust the rxilltoad company.
The Helix Herald, published at
Helix, Oregou, has gone out of busi
ness. M A. Feiguson, who bas been
editing the paper has made a desper
ate effort to keep tbe paper alive. He
bus been faithful in season and out of
season, bat it seems that tbe oity has
not been loyal in their support of tbe
paper. Mi. Ferguson wining tbe town
the highest prosperity, bat states:

or KugeueJ E. Kolmiltz, of Ban Fran
cisco, is almost completed. He start

threatre of that oity. This position

leaders.
When the labor unions of San Fran
cisco deoided to take an aotive band
iu municipal affairs, Sohmitz was nom
inated for the mayorality aud elected.
The early part ot his regime was
chiiicte 'ized by sanity and tagaoity,
and for a period be gave the city an
honest administration.
However, he soon fell into bad com
pany. His afUliatiou with Abe Ruef,
who afterwrd became bis yoke-fellow,
waa tbe direct cause of bia downward
career. The tremendous political ma
chine created by these two expert
grafters, who from penury became
millionaires, and who foroed all class
es ot crime to pay toll at their be
hests, defied decency and ruled the
city with a high hand up to tbe hour
ot five o'clock a. m., April 18, 1906,
wben the earthquake and fire wiped
tbe oity trout off tbe face of. tbe earth.
Tbe oniuocessfal attempt of Mayor
Sohmitz, should serve as a warning to
every man who baa like opportuni
ties, to maintain strict Integrity in
tbe discharge of putlio duties, it ia
almost impossible to escape tbe penal
ty of a bicken law. Tbe wages of graft
and tbeft are almost as oertaln physi
cally, aa tbey are morally and mental

Ora Allen Rowland.
Ora Allen Rowland, age five year,
eight months and tweuty-Bve days,
died at White Salmon Saturday, July
6, 1907. Tbe remains weie taken to
Mosier, Ore., for interment. Ibe fu
neral servioea were held at that plaoe
Sunday Jaly 7, at 1 p. m. Rev Btaik
officiated. The funeral waa under tbe
diretoion of J. E. MoboJs, undertak

at 11 :05 a. m. Tbe funeral services

baa been in poor health for some time
ana at last succumbed to an attack of
heart trouble. Tbe body will sent
to tbe crematorium for disposition.

Lawrence Qerdes met with a serious
aooldent last Wednesday while riding
his "bike." Tbe machine ran away
and iu trying to protect himseli he
fell against a I roe and spiaiued his
wrist in a very orltioal manner. An
examination of tbe wrist with tbe x-
ray disclosed the fact that none of the
bones were broken.
Peter Koptke returned from his trip
to Germany last Sunday. He reports
having bad a good time In tbe old
country, and the trip was made with
out aooidents. When asked by a re
porter it he would enjoy living in that
oountry since he bits been In America

Maltie Dukes Exonerated.
Word reached this city last .Thurs
day that Maltie Dukes was nr routed in
Portland for an attempt to derail s
street oar by placing a large dyna
mite bomb upon tbe track. The re
port caused quite a sensation here as
Maltie is so well known in this city,
ibe true rtatus of tbe case Is as fol
lows: A Maltie was going from bis place
of business over to bis boarding house
on Alblna side, be discovered a small
torpedo laying on tbe street oar rail
and picked it np and carried it over
and placed it on the track opposite to
bis boarding place with tbe thought
that be would enjoy tbe fun of bear
ing the report. Tbe .torpedo was oi
tbe ordinary olts used for signaling
trains and I he young man thought
nothing further of the matter. To
wreck or cause any damage to the car

made by an over throw by Sheets, two
on errors by Luckey in right field,
two by Hart on grounders and one by
Richardson. After the first three in
nings our boy settled down anil
played One ball, blanking tbe visitors
until the first half ot tbe ninth. Our
boys boo led in the third and sixth in
nings. Hamilton did great batting
for tbe home team. Frenob pitched a
tine game, allowing six bits and strik
ing out eight men. Higgin allowed
six bits and struck out five men. Bad
our boys played ball behind French,
as did the visitors behind Higgine,
Hood River would have won. How

Mrs. John Roger wins out in tbe

cure the oustody of an eight year old
obild which, by order of tbe court,
had been granted to Mr. nessei (Mrs.
Roger's previous husband) in the
settlement of tbeir domestic attain
some years ago. At tbe time of the
settlement of arfaira between Mr. and
Mrs. Kesael. tbe court awarded the
three minor children to tbe father
aud after bis death Mr. Knox was an
pointed guardian. Tbe two older ones
were left with parties in Hood River,
but the mother took tbe youngest and
decarted for tbe Sound. She has re
oently returned to thia place, and now
tbe guardian, Mr. Knox, seen io re
cover possession of the child. Tbe
mother stubbornly refused to reno
quiso her olaime to tbe little one, and
battle ot word ensued in which
Mrs. Rodgers proved too many for
tbe wise sages of the law.

. RESTORATION TO ENTRY OF
LANDS IN NATIONAL FOREST.
Notice in hereby given that the lands described
below, embracing 810 acres, within the Cascade
National Forest, Oregon, will be Bubject to settle
ment and entry under the provision of the home
stead laws of the United States and the act of
June 11. 1908 (34 Stat., 13), at the United States
land office at Portland, Oregon, on September 2,
IW1. Any settler who was actually and in good
faith claiming any of said lands fur agricultural
purposes prior to January 1, 1906. and has not
abandoned same, has a preference right to make a
homestead entry for the lands actually occupied.
Said lands were listed upon the applications of the
persons mentioned below, who have a preference
right subject to the prior rightof anv such Hettler.
provided such settler or applicant is qualified to
make homestead entry and the preference right is
exercised prior to Septemper 2, 1907, on which
date the lands will be subject to settlement and
