An ordinance to license, tax and ri'Kiilute drinking shops, tippliug houses udJ the sale of spirituous, vi licmt) and malt liquors in quantities Jess than one gallon in ttie City of Hood liWer. The City of Hood River does ordain as follows: Section 1. No person shall be per mit ed to soil spirituous, vinous or limit liquots tu less quantities than oiiokiiHoii, oi open, maintain or carry ou any saloon, bur-room oi drinking shop, or any plnoe where spirituous, vin jus or malt liquois are kept for sale, and no person shall in auy man ner dispose of or sell, barter or de liver, or in auy way disposo of for or on his or their or any other person's account any spirituous, viuous or malt liquors in any such bar-room drinking shop or place, without first having procured a license from the . common council of said City of Hood River for that purpose as in this or dinance hereinafter provided, and every person violating tho provisions ot this section shall, upon conviction thereof, be mulshed by a fine of not less than ."(, or more than $'200, or by imprisonment in the city jail not less than ten nor more than fifty days, and in addition thereto shall forfeit any license such peison may have to sell spirituous, vinous or malt liquors in quantities less than one gallon. Provided that the following persons shull not be entitled to take out a li cense for the sale of such liquors: the keeper of any gaming or gambling house, or disorderly house, or place or house resorted to for the purpose of fiiiuibliug, or for the purpose of prostitution, or freououted or visited by lewd or disorderly women; the keeper or keepers, proprietoi or pro prietors of any bar-room or drinking shop conducted direstly or indirectly with or in conuectin with any bawdy douse, or contrary to the laws of the state of Oregon; person! who have been within one year convicted of the violation of any part of this ordi nance, cr who are not well disposed toward the good order or peace of so ciety ; persons who are not of good moral character. Section '1. Every person obtaining a license to sell spirituous, vinous or malt liquors under the provisions of this oidiuance shall pay the tieasury of said City of Hood Kiver the sum of $1,1)00 per annum. Provided that no license shall be issued for a lees period than one year. Section '&. Every person applying for a license to sell spirituous, vinous or malt liquois in quantities less than one gallon, before seouriug the same shall execute to said City of Hood Kiver a bond in the penal sum of 1,000, with two or more sufficient sureties, or signod by some reliable surety company authorized by law to execute such bonds in this state, which bond must be satisfactory to the common council of said city. The suid bond shall be conditioned that the applicant therein named shall comply with the laws of the state of Oregon and the ordinaries of the City of Hood Kiver pertaining to the sale and otherwise handling and disposing of such liquors, and especially that t'ie applicant will keep an orderly house, and that he will keep his place of business closed from twolve o'clock p. in. ot each day until live o'clock a. in. of each succeeding day, and that he will not permit any unlawful gam ing, or riotous conduct in or about his bouse, and that he will not open or permit to be opened bis place of business for the purpose of traiilo on the first day of the week commonly kuowu as Suuday; that he will not give, sell nor supply spirituous, vi nous or malt liquors to any minor or habitual drunkard, or to any person at the time in a drunken condition. And iu the case of the violation by any presou obtaining such license of any of the conditions of such bond, the mayor ahull immediately com mence a proceeding iu any court of competent jurisdiction to recover the pouulty therein provided. Section i. Any person wishing to sell spirituous, vinous or malt liquors in less quaut'it ies than one gallon in said C'itv of Hood Kiver shall at bis own exiiense obtain the'sianatures of an actual nnijurity of the whole num ber of legal voters in the said City of Hood Kiver to a petition to the common council, piaying that said licence be grautcd, and no applicant shall bo deemed to have majority of tho legal voters of the suid city whote neliiiini does not contain the names of a number of the legally qualified voters of the City of Hood Kiver equal to a majority of all the votes cast iu said city at Jthe lrfst preceding city election, ouch petition may be pre sented to the common council at any regular meeting. Such applicant shall alto cause a notice of the time and rdace of such application to be published iu at least one issue of a weeklv newspaper published in said City of Hood Kiver next preceding the meeting of the common oounoil at which said rei tt ion shall be pre souted, which publication shall be proven by the aflldavit of the editor or tiiiblishei of such newspaper. Said notice shull state the name of tbe ap nilcant. the looation of the saloon, the date of the hearing before the council, and;thatobjections,;if auy, to the erantinu of such license may tnen and there be heaid. Provided that such netitiou shall specify the loca tion bv street and number in said City of Hood Kiver where said busi ness is to be carried on. Section 5. Seotiou 7. If auy person shall open or permit to be opened for tbe purpose of traffic, any bouse or room which spirituous, vinous or malt uuors are kept for sale iu said City of Hood Kiver ou the first day of the week commonly oalled Sunday, or on the day of any national election, oi on the day of any general or special election of state, county, precinct or city oillcers, or betweeii tbe hours of twelve o'clock p. m. midnight ot each day and five o'clock a. m. of each suc ceeding day, or shall sell, give away otherwise dispose of any such liquors on any of said days in said City of flood River, such person shall, upou conviction thereof, be punished by a fine ot not less tnau fifty or more than two hundred dol lars, or by imprisonment in the oity jail not less than ten nor tnore than litty days, and shall also forfeit any license any such person may have to sell such spirituous, vinous or malt said City of Hood Kiver sell or give any spirituous, vinous or malt liquors any minor or to any woman, or io auy habitual drunkard, or to any per son at the time in a drunken or intox icated conditioon, or to any Indian, or if any person having obtained a li cense to sell such liquors as in mis oidiuance provided, shall permit by imselt or another, auy minor or oman to frequent, visit or loiter in is place of business, oi io any room r place connected herewith in any capaoity whatever, such person shall upon conviction thereof, be fined not less than fitty nor more than two bull ed dollars, or shall be imprisoned tbe oity jail not less than fifty days, and shall also forfeit any license be may bave to sell spirituous, vinous or malt liquors in quantities less than one aallon.
