WASHINGTON (UPI) - The
Supreme Court today reversed
the contempt convictions of two
Southern segregationists who
had been joined in their appeal
by the NAACP, the American
Civil Liberties Union and the
Justice Departnent.
The court sidestepped a
broader issue presented by the
case: Whether a court order In
volving free speech and assem
bly can be tested by disobedi
ence or whether it must be ap
pealed through legal channels.
The justices, In their brief
unsigned opinion, merely cited
a lack of evidence as the rea
son for the reversal.
Convicted of Contempt
The two men involved wore
Edward R. Fields, party infor
mation director of the National
States Rights party, and Rob
ert Lyons, youth organizer for
the group. They were convicted
of contempt after being forbid
den to distribute handbills and
hold an anti-integration meeting
in Fairfield, Ala.
In another action, the court
refused s hearing to a group of
Negroes who challenged Mis
sissippi's segregation statutes.
The Negroes, headed by the
Rev. L. A. Clark of Jackson,
had been turned down in lower
federal courts on grounds they
could not act for all members
of their rnce a practice known
legally as "class action."
The court also:
Agreed to decide a bound
ary dispute between Louisiana
and Mississippi involving oil
rich land under the Mississippi
River. Louisiana authorities
were authorized to file the suit
with the high trlbual and Mis
sissippi was given 90 days to
file an answer.
Cases Thrown Out
Threw out two cases deal
ing with obscenity tests in Lot
Angeles involving the Henry
Miller book, "Tropic of Can
cer." It rejected an appeal by
City Attorney Roger Arnchergh
who had been challenged "by a
bookseller on grounds the novel

(UPD-The bodies of three U.S.
Army soldiers lost when their
helicopter crashed off the coast
of South Vict Nam Saturday
night were discovered today
washed ashore on a remote
beach.
Names of the dead were with
held until their relatives are
notified.
An American military spokes
man said it appeared that the
three men drowned.
129 Americans Killed
Their deaths and that of a
U.S. Army officer killed by
Communist Viet Cong guerril
las Sunday raised to 12 the
number of American fatalities
In the past four days. A total
of 120 Americans now have
been killed in South Viet Nam
combat since January, 1961,
when the U.S. buildup began
here. Another 29 U.S. troops
have died in non-combat acci
dents. In Washington, the Army
identified the slain officer as
Capt. Lloyd A. Payne of Colum
bus, Ga. His widow, Mrs. Jane
B. Payne, lives at 890 Morris
Rd. in Columbus.
A U.S. military spokesman
gave these accounts of the two
incidents:
The officer was shot by a
Communist heavy machinegun
in an operation against the
guerrillas just after dawn Sun
day In central Vict Nam.
He was serving as a military
adviser to a South Vietnamese
unit In a drive against the guer
rillas in 4he mountains of
Quang Tien Province, 340 miles
north of Saigon.
He was killed by a single shot
in the chest. Other casualties
were not known.

mile off the coast of central

Carnival Workers
Sought for Murder
BUCKHOLTS, Tex. (UPI) -Texas
rangers, FBI agents and
police with bloodhounds
searched door-to-door In this
central Texas town today for
four sloppy looking carnival
workers wanted for murder in
Alabama.
A force of 75 officers worked
on the theory that the men were
on foot and might have holed
up in a home with hostages.
Roadblocks were set up to pre
vent an escape by stolen car.
Police brought bloodhounds
from the Texas state prison at
Huntsville, 100 miles away.
Residents were warned that
the four men were armed and
considered "dangerous" after a
crime spree that included
charges of robbery in Texas
and Oklahoma.
The men were identified as
Clarence Cecil Coon, 21; John
Lucas, alias John Edwards,
alias Harold Lcroy. 19: Gerald
Eaton and Dennis Woods, 17.
They were charged with mur
der Friday night in the slaying
of Leonard Culpepper, 55, at
York, Ala.

SALEM (UPI) -No decision
was made Saturday by the leg
islative Interim Committee on
Insurance on whether to conduct
an investigation of fire insur
ance grading methods for Ore
gon cities.
The League of Oregon Cities
asked the legislative group to
make the study.
Spokesmen for the National
Board of Underwriters and Ore
gon Insurance Rating Bureau
appeared before the day-long
session of the committee here
to deny the need for such a
problem.
Based on Grading
Fire insurance premiums paid
by householders and business
firms are based on the under
writers' ratings bureau's grad-
. ing of city fire fighting capabili
ties.
Don Jones, spokesman for the
League, charged the under
writers' manpower requirements
were unreasonably high, that
not enough credit is given for
fire prevention work, that city
officials are not consulted about
revisions in the grades and that
inspection are infrequent and do
not reflect up to date informa
tion about cities' fire defenses.
Fire chiefs and mayors from
throughout Oregon attended the
meeting.
Opposing the request were W.
F. Williams and Carl Weers, of
the San Francisco office of the
National Board of Fire Under
writers, and A. J. Snow of the
Oregon Insurance Rating Bu-rca.
Fog Causes Two Auto Accidents
Weather conditions contribut
ed to two accidents Sunday on
Jackson County highways, ac
cording to state police.
A three car collision occurred
Sunday morning at the inter
section of U. S. 99 and Stewart
Avenue when a car driven by
John Franklin Buckner, 60,
Compton, Calif., was unable to
stop on the icy pavement. His
car hit the rear of one driven
by Melvin Dean Barnes, 28, of
4502 Crater Lake Highway,
which in turn was knocked into
a car driven by David James
Huckaba, 18, of 318 E. 12th St.,
Medford.
A car, operated oy Scott Har
old Sanderson, 18, Oak Harbor,
Wash., Sunday night turned over
five or six times after it struck
the rear of a pickup truck driv
en by Kenneth James Kennedy,
54. Grants Pass, on the Inter
state 5 at the Gold Hill Inter
change, state police said.
Both cars received extensive
damage, but no injuries were
reported. Sanderson was cited
by state police for violation of
basic rule.
Williams said many of the ob
jections voiced by the cities
were outdated and had already
been corrected by changes in
the rules.

He said statewide fire loss ex
perience was the major factor
in setting fire insurance rates,
not the ability of individual
; cities to fight fires.
! He said if the rates for each
city were based on that city's
fire loss alone, a major fire
could force insurance rates up
! so high nobody could afford in
