"NO TRESPASSING
HUNTERS BEWARE"
Any person who enters upon
the land of another without
authorization is a trespasser. A
trespasser may be subjected to
a civil liability or criminal pen
alties or both, depending upon
the applicable law.
By common law, a trespasser
is liable to the landowner for
damage caused to the land or
the structures thereon by rea
son of the trespass. This civil
liability for damages applies to
any lands of another whether or
not they are inclosed or culti
vated. In addition to the civil liabil
ity, the Oregon legislature has
enacted several statutes impos
ing criminal penalties by way
of either imprisonment or fine
or both for trespass on cultivat
ed or inclosed lands.
One statute makes a misde
meanor the mere entry on in
closed lands and refusal to de
part upon verbal, written or
printed notice of the lawful oc
cupant of such lands. This
statute defines inclosed lands as
"any barrier such as a river,
lake or other obstruction to the
passage of stock and also the
established and posted boun
daries of Indian reservations
within the State." It further pro
vides that the printed or written
notices must contain the name
of the owner or lawful occupant
of the lands and must be posted
in three conspicuous places on
the lands. Posting applies to all
persons other than the owners
or lawful occupants of lands.
Therefore, the landowner may
hunt on his land whether posted
or not, as can anyone else who
obtains permission to do so.
A special statute applicable
to hunters further provides that
a person hunting with a gun or
dog on cultivated or inclosed
lands of another without per
mission can be prosecuted upon
the sianina of a complaint by
the owner, occupant or lessee of
sucn lands.
In addition to the civil liability
imposed under common law and
the criminal penalties imposed
by the statutory law, the Ore
gon legislature has enacted
another statute to discourage
trespassing. It provides that a
licensed hunter or angler crim
inally convicted of destroying
or damaging anyone s personal
or real property snail lose his
hunting or fishing license for
the remainder of that year and
for the succeeding year.
