That Plaintiff have Judgement
against the above named Defend
ants. Tommie G. Fodgc and Joyce
C. Fodgc, husband and wife, for
the sum of Two Thousand and
NolOOths Dollars ($2,000,001 plus
interest thereon at the rate of four
per cent (4rJ) per annum from the
ltith day of April. 1957, until the
date of entry of Decree herein, and
for the further sum of $500 attor
ney fees and for the sum consti
tuting the Plaintiff's costs and dis
bursements taxed herein.
That that certain mortgage,
dated the Kith day of April, 1U57,
securing a promissory note dated
April 16. 1957, made and delivered
by the Defendants, Tommie G.
Fodge and Joyce C. Fodgc, to
Plaintiff, Allie A. Thomas, at
Rogue River Oregon, and recorded
on the 30th day of April, 1957. in
Volume 326, Pages 157 and 158.

That the real property described
In said mortgage situate in Jack
son County. Oregon, to-wit;
The Southwest quarter of the
Northeast quarter of Section
5. Township 3(i South; Range
4 West of the Willamette Meri
dian. ALSO, all of Lot 2 lying
South of the now existing
Countv Road in the Northeast
one-quarter of Section 5,
Township 36 South, Range 4
West of the Willamette Meri
dian, Jackson County, Oregon,
consisting of approximately 47
acres, more or'lcss,
he sold by the Sheriff of Jackson
County, Oregon, according to the
law and the practice of the Court;
that the proceeds of said sale be
applied to the payment of the
amount due the Plaintiff from the
Defendants Tommie G. Fodge and
Joyce C. Fodge. and that all the
Defendants, each and every one,
and all persons claiming by.
through or under them, cither as
purchasers, encumbrancers or
otherwise, subsequent to the exe
cution of the said mortgage, be
barred and foreclosed of any and
all right, title, lien, estate, or in
terest in and to the above describ
ed premises except the right of De
fendants Tommie G. Fodge and
Joyce C. Fodge to redeem said
premises as provided by law.
That the Plaintiff or any other
party to the suit may become a
purchaser at said sale, that the
Sheriff execute a certificate of title
to the purchaser, that the Pur
chaser be let into Immediate pos
session of the premises on the
production of tthe Sheriff's Certif
icate or Title therefor, and that
said sale be confirmed by the
Order of this Court and upon the
expiration of the redemption peri
od as provided by law in the event
of said premises not beint redeem
ed by the Defendants. Tommie G.
Fodgc and Joyce C. Fodge, a deed
he issued by the sheriff to the
purchaser conveying the premises
to the purchaser, and that the
Court make and enter an Order
for such other and further relief
as to the Court may seem just and
equitable.

western white pine, ponderosa pine
and sugar pine 104.28; Shasta red
fir 97.35 (Bs; white fir and other
species 91.68 (A). Such adjustments
in the price for stumpage shall be
applicable to timber scaled during
the three-months period following
the quarter for which the adjust
ment is computed. In no event,
however, shall the payment rates
for each quarter be less than the
base rates as stated above. When
the adjusted rates by species are
lower than the base rates, the dif
ference between the total dollar
value of the timber cut at adjusted
rates and at base rates wilt be re
corded for each species. The stump
age rate for any species will not be
increased above the base rate until
the subsequent adjusted rates above
the base rate for all species develop
an accumulated total dollar value
in excess of the total recorded ac
cumulated difference for all species.
Sealed bids will be publicly opened
and posted, at the office of the
Forest Supervisor, Medford, Ore
gon, at 10:30 A. M.. P. D. T., on
June 7, 1963. All those who submit
ted a satisfactory sealed bid will be
permitted immediately to continue
auction bidding. A money order,
bank draft, cashier's or certified
check in the sum of $8,700 must ac
company each bid. to be applied to
the purchase price, refunded, or
retained for application to any
claim for damages, according to
the conditions of sale. If requested
by the purchaser, contract terms
will permit felling of timber in ad
vance of payment up to the value
of the performance bond. If an oral
bid is declared to be hish At the
closing of the auction, the bidder
must immediately confirm the oral
bid by submitting it in writing on
a Forest Service bid form. The
right to reject any and all bids is
reserved. Forest Service bid lorms
for use in submitting sealed bids
and full information concerning
the timber, the conditions cf sale
and the submission of bids should
he obtained from the District
Ranger, Union Creek Ranger Sta
