Executive
Attacked by Speaker
Eugene The doctrine of
"executive privilege" used to
invoke secrecy in government
affairs was attacked recently
by Clark R. Mollenhoff, chief
of the Washingon, DC, bu
reau of Cowles Publications.
He made the attack when
delivering the annual Eric W.
Allen Memorial Lecture dur
ing the 44th annual Orcson
Press conference at the Uni
versity of Oregon. The con
ference was co-sponsored by
the Oregon Newspaper Pub
lishers association and the
University's School of Jour
nalism. The Allen Lecture is in
memory of the late Eric v.
Allen, the first dean of the
School of Journalism, which
is now celebrating its 50th
anniversary.
"The 'executive privilege'
doctrine is a naked claim to
unlimited secrecy on the
whim of the executive
branch," Mollenhoff said.
"It has been used to bar
the press, the public, the Con
gress, and the General Ac
counting office from examin
ing government business. It
has been used to hide scan
dals and mismangemcnt in
our rcsulatory agencies, in
the foreign aid program, and
in Ihc defense department."
He said it was not enough
for newspapers to shout for
"freedom of the press. There
is one thing that every citizen
can do. and that every news
paper should do, in opposing
the Washington cover-up:
Give full support to Congress
in asserting its right to inves
tigate government activities
and government spending."
The Eisenhower adminis
tration barred Congress from
records or testimony concern
ing advice of high level of
ficials,' and the Kennedy ad
ministration has extended this
policy so that it is not possible
to question subordinate of
ficials of the career service
on their official acts, Mollen
hoff said.
This led to the directive of
Arthur Sylvester, assistant

tinued criticism, I have no
doubt the Sylvester order will
eventually be modified or
withdrawn," he said.

turn give way to a whimper
ing acceptance of the chains.
The short attention span of
many newspapers will mean
that the Sylvester directive
will be forgotten."
He said the Congress rep
resents the only effective
check on the excutive branch,
"I am not advocating that
you should agree with the con
clusions that any or all com
mittees of Congress may reach
in an investigation, I do sug
gest that you support the full
right of Congress to call for
documents and testimony in
porperly authorized investiga
tions of government activities.
"The executive branch of
the government has grown
more powerful year after
year, and it seems unlikely
that this power will be cut.
If that power is unchecked
then we will have lost one
of the most important aspects
of our form of government
the cheeks and balances."
