McShane Is Head
01 Enforcing Law
Of Constitution -
By FREDERICK H. TREESH
United Press International
.Tnst hnfnrp mirlniuht. NoVi
9, 1939, Patrolman James Jo
seph Patrick McShane was
walking his beat in a lough
neighborhood on Manhattan's
west side. .
Suddenly, two men ran
from a grocery store toward
an automobile cruising slow,
ly on Columbus ave. McShane
sprang for the car, loo, and
brought his nightstick thun
dering down on the driver's
head. He turned, gi'--in-hand,
as the other two men started
to run.
"Halt," McShane shouted.
One man kept running. The
other stopped ana lurnea,
leveling a revolver.
McShane shot first, fatally
wnunriine the gunman. Mc
Shane fired twice more, pos
sibly wounding tne oiner
man. They had i:si roDDea
the grocer and his late-night
customer of $400. The score:
One man dead, one capturea,
one escaped. McShane un
scathed.
Promoted to Detective
For his deed, McShane was
promoted to detective and
treated to a ham and est
sandwich in the office of
Mayor B'iorello LaGuardia.
Before he resigned from
tho police force in 1957 after
21 years service, brawny,
square-jawed former boxer
McShane won 12 citations for
bravery- He also got busted
once (he was reinstated two
weeks later) for holding an
umbrella over the head of
heavyweight champion Rocky
Marciano. His superiors
thought the widely published
photograph of his act was
not in ihe best interest of the
rff-riartmont's dignity.
In recent days, lawman mt
Shane hag been enforcing the
biggest law of them all - the
U.S. Constitution. Now Chief
U.S. Marshal, he has been in
personal command of the
800-odd marshals, border pa
trolmen and federal correc
tion, nfficers who with th.
army forcec tfie integration
of ihe University oi Missis
sippi. As usual, McShane was In
the thick of the battle and in
the thick ot controversy.
Trigger Violence
Mississippi otliciais cnargea
that his marshals fired the
first tear-gas shot into a then
orderly crowd, triggering th.
violence. Federal officials
said the marshals did not act
..m aHak-pH .hv the mob
and commended them for not
..ohm thnlr sidearms despite
the ferocity of the fight.
Before Mississippi, M o
Shane had been accompany
i fnoitlve sov Dr. Robert
Soblen from Israel back to
the United States ana a iu
..i.nr, inn met. somen
thwarted his return by stab
bing himself with a concealed
steak knife. He later took a
massive dose of drugs in a
London hospital . and died.
Soblen was being flown back
in an Israeli plane and was
not to be in McShane cu-
today until it reacnea iew
York. , , - .
McShane was not blamed
for Soblen's suicide attempt.
Association With Brothers
Always a hail fellow well
met, McShane ascended to his
chief marshal's spot after a
close association with the
brothers Kennedy - wun nuo
ert as an investigator for th.
Senate rackets committee
(the attorney general then
was chief counsel for the com
mittee) and with John as a
security guard during th.
I960 presidential campaign.
President Kennedy named
McShane marshal for the
District of Columbia soon aft
er he took office and up
graded him to chief marshal
later.
James Joseph Patrick Mc
Shane was born on St. Pat
rick's Day, 1909, in the sha
,iu, nf New York's ' Polo
Grounds. He grew up on New
York s east side ana was an
electrical repairman before
becoming a policeman at 27.
Has Quick Wil
Quick with his gun and his
fists, McShane also had a
quick wit. (Once asked how
he escaped in a shootout with
some burglars, he explained:
"I went to bobbing and weav
ing school.") A fellow detec
tive described McShane as a
comic, excellent with several
dialects. The detective re
called McShane as "charm
ing," not tough guy type.
U.S. marshals and their dep
uties are the enforcement of
ficers for the federal court
system. They are the process
servers for federal courts and
are in charge of prisoners in
transit and executions.
They are empowered to
deputize whomever they need
in performance of their du
ties. Marshals are the oldest ot
! t h e n a t i o n's enforcement
arms, the first l.i having been
appointed by George Wash
ington in 17M. Their ranks
novo Included such fabled
characters as Wya't Earp and
Rat Masterson, And Jamei
Joseph Patrick McShane.
