Ruling Exempts
Some Teachers
Salem-HTO-The State Board
of Education has decided
to exempt certain persons
from its new requirement that
grade school teachers must
have five years of college
training before they can be
certified.
The exemption covers those
who put in at least one year
of teaching in the five years of
holding a basic certificate.
This means that only those
who were granted a certifi
cate and then did not teach
for five years will have to
take a fifth year of training
before their certificate can be
renewed.
The policy is effective until
altered by the board.
The board also voted to ask
the 1963 legislature to let the
board set the salary of the
state superintendent of public
instruction. His salary now is
set by statute.
Research Team To Try
Mount Everest Climb
Washington -OIPIU The first
attempt to plant the United
States flag on the summit of
29,028-foot Mount Everest is
being planned for next year.
An 18-man team sponsored
by the National Geographic
society will carry out ex
tensive scientific research on
the mountain, which is the
world's highest.

circles and business publica
tions on grounds the Depart
ment of Justice has gone to
harsh extremes to whip some
segments of business into line.
He and his chief trust-buster,
Lee Loevinger, also have
been accused of easing off on
anti-trust prosecutions because
of the national economy's
sluggish behavior and to end
some of the big business hos
tility toward the administra
tion. "We've done a good job.
and we've done it with vigor,"
the 36-year-old Robert told
UPI. "But I am sure there are
improvements to be made and
I hope in the next two years
we'll do better."
He shrugged off one charge
of "extremely unsatisfactory
performance." This was level
led at him and Loevinger by
a university professor who
testified before the Senate
House economic committee.
Kennedy said most academ
ic critics talked in generali
ties but made no specific sug
gestions. 'Quite Nebulous'
As to complaints of drastic
enforcement, the attorney
general said they were "quite
nebulous when examined,
He was asked whether it
was true that some anti-trust
actions had been deferred be
cause the business picture was
below standard.
"No case has been turned
down because of it," he re
plied. But he added that if a
recession developed it might
be a factor in determining
whether to proceed in some
cases.
Kennedy told the American
Bar association convention
recently that anti-trust law
was the "most technical and
complicated field" under his
supervision. He said it re
quired "deep study" before
suits could be filed. But it
was his intention, he said, to
protect the free enterprise
system by insuring that com
petition will prevail in the
market place.
A justice department offi
cial said in this connection
that there is a tendency to
play down anti-trust actions.

action to charges made after i
the President's steel price in-1
crease rollback last April that
the administration is anti
business. Convened Jury
The attorney general con
vened a federal grand jury
during the steel price crisis to
determine whether firms
which raised prices $6 a ton
had conspired beforehand or
whether there was a tendency
toward monopoly in the industry.
All the evidence is not in
and the study is continuing,"
Kennedy said. Other sources
said the grand jury still was
enmeshed in the industry's
long-time pricing practices.
Perhaps the biggest case
brought during the Kennedy
administration was indictment
of General Motors corporation
on charges of using illegal
methods to capture 84 per
cent of the nation's locomotive
business for its electromotive
division.
The indictment, returned
less than three months after
the New Frontier came into
office, obviously was prepared
during former GOP Atty. Gen.
William P. Rogers' tenure. GM
has denied the charges.
Robert A. Bicks, former
anti-trust chief who brought
the famous electrical industry
conspiracy cases, was in office
when a record-high 90 cases
were filed in 1960. This com
pared to 60 in 1961 and 73
during the fiscal year ending
last June 30.
Signs
But Loevinger and his aides
pointed to the following as
signs of the Kennedy admin'
istration's "vigorous" attitude:
- The department for the
first time sought to use the
anti-trust laws to block or up
set bank mergers.
-Government lawyers set a
precedent ,when they filed
eight lawsuits claiming dam
ages from the electrical com
panies convicted of price-fixing.
They also negotiated the
highest settlement in anti
trust history - $7.4 million -with
General Electric co.
-For the first time in his
tory, a comprehensive report
on identical bids submitted to
federal, state and local gov
ernment agencies has flashed
"warning signals" of possible

filed to dissolve or prevent
mergers that allegedly would
choke off competition rose
last year to an all-time peak
of 19.
'Pro-Business'
Loevinger said these and
other measures were "pro
foundly pro - business" since
they are pointed at preserv
ing the competitive system.
Two-thirds of the 1,200 com
plaints received each year
come from businessmen, he
said.
Liberal economists have
contended the justice depart
ment should break up giant
firms in basic industries-auto,
steel, chemicals - to prevent
illegal concentrations of pow
er. To this, Loevinger replied
that size alone is not sufficient
to trigger anti-trust action. He
said there also must be a
showing of tendency toward
monopoly or substantial re
straint of competition, before
the laws can be invoked. In
addition, he pointed to indict
ments against U.S. Steel and
Bethlehem Steel for alleged
price-fixing for forgings and
civil suits against Ford, Gen
eral Motors and Chrysler on
a variety of charges.
Some observers believe
anti-trust policing does not
vary a great deal no matter
who controls the White House.
They say lengthy preparations
required before the filing of
suits and long trials and ap
peals make it difficult for any
administration to make a dis
tinctive anti-trust impression
in less than two or three years.
If that is true, the cases to
be brought during the re
mainder of this year and in
1963 may provide a better
gauge for assessing the Ken
ncdy administration's record.
