forests support his findings
that mineral claim patents are
being misused and adverse to
public interest.
In an official report, Camp
bell reported that in both Ore
gon forests, mining claim
owners are preventing access
to timber and other resourc
es. He also charge that in
the Rogue River forest, tim
ber has been improperly cut
from some claims without
mineral development, and
that in Siskiyou forest, claims
have been located on lands
not open to mineral entry.
Stiff legislation is needed
to stop illegal or improper
use of mining claims and to
protect the government inter
est in timber and access to
timber, Campbell recommend
ed in his report to Congress.

400 million board feet pub
licly owned and 200 million
of privately owned timber.

has prevented measures to
control destructive dwarf mis
tletoe and a threatened beetle
epidemic.

to be invalid, the comptroller
general stated.
The government recently
reacquired surface control on
251 of the 271 claims, which
contain 67 million feet of tim
ber valued at $1,266,000 on
grounds that required miner
al development was not go
ing on, and now has schedul
ed the sale o' nine million
feet in the irea next month.
In the Rogue River forest,
Campbell cited the case of a
single claimant who patented
23 mining claims covering
475 acres in 1954, for which
the government received $2,
375. By the end of 1959,
Campbell said, the patentee
had sold $150,000 worth of
timber from eight claims
alone, although there was no
mineral development on any
of the 23.
"The situation is such that
Congress should consider new
laws which would deserve to
the government title to non
mineral surface resources on
mining claims, and guarantee
to it rights-of-way across min
ing claims," Campbell assert
ed. "In our opinion, such leg
islation would tend to min
mize right of way access
problems .in the future and
discourage the patenting of
claims primarily for nonmin
ing purposes and would en
able the Forest service to
manage the timber and other
non-mineral surface resources
to which patentees now ob
tain ownership without pay
ment of fair market value to
the government," Campbell
said.
