Germany Convicts U.S. Businessman
Karlsruhe, Germany - (UPI) -American
businessman Harold
Noah Borger was convicted
today of attempting to spy
for Communist East Germany
and sentenced to two and one
half years in prison.
Borger, 42, who was born
in New York City but has
lived for several years in
Europe, was the first Ameri
can sentenced for espionage
by a West German court. He
was tried by the Supreme

The former Air Force major
had pleaded not guilty to the
charges. He said he came to
Germany to buy television
cable for an American firm
and went to Communist East
Germany on business.
But the court found him
guilty of having served as an
agent of the East German
military intelligence from
February! 1960.
He was convicted largely on
the testimony of an East Ger
man defector, Guenther Maen
nel, who was a top official
of the Communist intelligence
before he fled to the West
several months ago.
Five American soldiers, all
stationed near Nuern berg,
testified during the trial that
Borger tried to obtain mili
tary data from them, includ
ing details of an evacuation
plan for U.S. military depen
dents and information on
atomic warfare plans.

hower expressed concern to
day over growing concentra
tion of federal power and said
the trend poses the "real
threat to liberty in this re
public." In a Capitol Hill news con
ference, the former president
cited five current proposals
for increasing presidential
powers. He said the objectives
underlying many of them are
noncontroversial but disputed
the need for more presidential
power.
"I believe the problem of
the presidency is rarely an
inadequacy of power. Ordi
narily the problem is to use
the already enormous power
of the presidency judiciously,
temperately and w i s e 1 y,"
Eisenhower said..
Eisenhower met the press
in the Senate Caucus Room
after confering with Republi
can Senate and House leaders.
He said the discussions
"ranged the spectrum of gov
ernmental concerns - from
foreign affairs to pressing
problems here at home."
Attacks Heavy Spending
In the field of domestic af
fairs, he specifically listed
what he called strenuous ef
forts by the Kennedy adminis
tration to "increase greatly
the power of the executive
branch" and the administra
tion's "insistence upon in
creasingly heavy spending on
all fronts."
His opening statement, how
ever, dealt largely with the
question of concentration of
power in the federal govern
ment. He said:
"It has long been my judg
ment that the real threat to
liberty in this republic will
come not from any sudden,
calculated assault; rather, the
threat to our liberties will be
primarily found in a steady
erosion of self-reliant citizen
ship, and in excessive power
concentration, resulting from
the lodging of more and more
decisions in an ever-growing
federal bureaucracy."

The five Kennedy adminis
tration proposals cited by
Eisenhower were the adminis
tration's request for:
1. "Authority for the Presi
dent to modify income taxes
whenever he should so decide;
2. "Authority for the Presi
dent to finance, wherever
and whenever he pleases,
large-scale emergency public
works by diversion of funds
dedicated to the other pur
poses by the Congress;
3. "Authority to regiment
all agriculture, more sweep
ing and repressive than any
authority ever before sought
over any segment of the na
tion's economy;
4. "Authority for the fed
eral bureaucracy to take over
a whole host of state and local
responsibilities, notably i n
cluding the proposal for a De
partment of Urban Affairs;
5. "Authority to dilute the
independence of the Federal
Reserve Board by presidential
appointment of its chairman."
Eisenhower, tanned and

meetings with the party's
Capitol Hill leaders.
