Father's Will
Hiram died leaving three

shortly before his death giv

Adam. Bob and Cain each re
ceived about one-fifth of Hi
ram's assets, Shortly after Hi
ram's death, his three child
ren entered into a contract
whereby they agreed to with
hold Hiram's will from pro
bate and to divide his prop
erty equally. Later Adam's
wife, Jill, insisted that Adam
attempt to obtain the lion's
share of the property in ac
cordance with the will. Will
Adam succeed if he succumbs
to his wife's commands? .
THE COURT HELD: The
three sons will divide the
property equally and Adam
and Jill will have to be con
tent with one-third of Hiram's
assets. This answer is based
on the assumption that there
was no fraud or misdealing
involved1 in relation to the
contract. If all of the inter
ested parties .agree.. to divide
a dependent's property in a
manner other than that pro
vided for in his will most
courts will enfore the agree
ment. Although the deced
ents desires are not carried
out, it is redognized by the
courts that the parties can di
vide, the property any way
that they might desire after
it Is destributed to them and
an enforceable contract relat
ing to distribution makes pro

for a load limit of 15 tons
