Building On Wrong Lol
Causes Tangle
Glllis obtained a building
permit to construct a house on
lot 15 which he owned in a
new area of development. He
immediately started construc
tion on lot 16, thinking it was
lot 15; however, his mistake
was discovered more than a
month later, at which time it
was determined that Gillis
had invested more than $8,000
In the structure. Gillis sought
to purchase lot 16 from its
owner, Hall, who refused to
sell. Construction continued
for a short time and then was
halted when Hall instructed
that it be stopped. Gillis then
filed suit asking that either he
be permitted to purchase lot
16 or that Hall be required to
purchase, for a reasonable
value the improvements
placed on the lot.
THE COURT HELD: The
Supreme Court of Florida de
creed that Gillis and Hall ex
change deeds to their respec-
tive lots. It also determined
that Gillis had to pay Hall
$150 and pay the court costs.
The court was careful to point
out that it did not approve of
carelessness or laxness on the
part of Gillis in looking to the
location of the lot, but at the
same time, it could not see
that an exchange of lots would
harm Hall. In this decision it
was emphasized that neither
party contended that either of
the lots had any peculiar or
intrinsic value. (Florida, 84
So. 2d, 1956).

The announcement came
shortly after a Democratic
House caucus expressed "gen
eral approval" for two bills to
grant lake and beach ease-
ments necessary for construc
tion and operation of the $30
million plant.
Persons at the caucus said
one legislator, however, ex
pressed some fears the plant
might set a precedent for fu
ture industrial development
that would damage beach
areas.
