judge who sentenced him that
the court action was in excess
of the statutory limitation.
The Dekalb County sheriff's
office announced that King
was taken at 4 a.m. EST to
Reidsville State Prison, 211
miles, southeast of Atlanta
King received the four
months jail sentence, longest
in his career as an anti-segre
gation leader, Tuesday when
County Judge J. Oscar Mitch
ell said King's participation
in a sit-down demonstration
at an Atlanta department
store violated a . suspended
sentence for a traffic vio
lation.' '
Attorneys Argue '
While King was being tak
en to the prison, his attorneys
were arguing in court at De
catur, an Atlanta suburb, that
the four-month term was ex.
cesslve. Attorney Donald
Hollowell said the original
12 months suspended sen
tence was six months over
the statutory limitation for
having no driver's license.
The hearing was delayed
almost an hour ' following a
telephoned threat to Dekalb
County police that a bomb
would be planted In the
courtroom.
The hearing was changed
to a smaller courtroom and
fewer than 50 persons lnclud
ing reporters and staffs as.
signed to the case were ad
mitted.

holding the fate of Dr. H. Ber
nard Finch and Carole Tre
goff today will reach the 37
hour and 30-minute point in
deliberation the hour at
which the first trial panel
found itself in hopeless dis
agreement. At day's end Wednesday,
the 11 women and 1 man had
discussed the second murder
trial for 33 hours and 45 min
utes. In clusters of two's and
three's, they appeared tired
as they stepped aboard a bus
to be taken to a downtown
hotel to be locked up for the
night.
Rumor Circulates
For some 30 minutes In the
afternoon, the tiny Hall of
Justice courtroom resembled
that of the first trial. A rumor
had circulated that a verdict
could be expected within the
hour.
The , reporters regularly
covering the trial were hard
pressed to find a scat as
scores of other newsmen and
photographers swarmed into
the high-ceiling room on the
eighth floor.
It was over as quickly as it
started.

roy Dawson said co-prosecutors
Clifford Crail and Joseph
Powers "just dropped up for
a visit and wanted to know
what was cooking.
"I told them just what I'm
telling you," the jurist said,
repeating his : earlier state
ment that he was in no hurry
to poll the jury and planned
to "let them cook."
He noted the jury heard 12
weeks of testimony "I don't
think eight or nine days is
usually long for a verdict."
Courtroom observers, how
ever, felt that a second hung
jury was more than a remote
possibility.

eral Aviation Agency has
launched a program to clear
birds and animals from air
ports where they might cause
plane crashes,
In three separate actions,
obviously stemming from the
crash of an Eastern Airlines
Electra in Boston Oct. 4 -which
may have been caused
by a large flock of starlings
- the FAA Wednesday:
-Asked all airports to take
whatever measures are neces
sary to reduce the bird men
ace, and noted that local Au
dubon Society members and
wildlife experts may be able
to suggest control measures.
-Reminded its air traffic
controllers to be constantly
alert so pilots can be warned
of large bird flocks in the
vicinity of airports.
-Announced an intensive
study in "techniques and
equipment for controlling
birds, stray animals and other
wildlife at airports" as well
as stopped-up research into
mechanical devices that might
prevent aircraft damage from
bird strikes.

Appling Refused Labor Press Ads

day that 'the Oregon "Labor
Press has refused to accept
his campaign advertising.
Appling, candidate to suc

of 83, took a fast round-trip
jet plane flight and - pro

ever go again," said William

He left Dallas at 2 p.m. and
returned at 5:05 p.m. in plen
ty of time for dinner.
"I've got a birthday coming
up and my son asked me if
I'd like- to take a ride in a
jet as a present. I told him
'yes, I would,' " the retired
furniture manufacturer , bub

Official Oregon Voter Figures Show 900,616
Salem - IUPD - Oregon has a
record 900,616 voters for the
Nov. 8 election, official fig
ures showed today. The Demo
crats have a lead of 75,393.
The totals were slightly
higher than unofficial figures
released earlier this week.
Both party totals and the
state total .went up due to a
change in Douglas county
figures. , ,
The official figures are:
Democrats 480,588; Republi
cans 405,195; other 14,833 and
total 900,616 - a record.
The revised and official
Douglas county figures in
clude Democrat 17,763; Re
publican 13,325 and other 593
for a total of 31,591.
