On Murder Charge
Portland (UPD - Lewis Hunt
er, 53, Portland, was jailed
Sunday on the charge of the
llrat degree murder of an
other Portland man,
Hunter Is being held with
out bail.
He ii charged with killing
Willie G. Townsend, 38, Sat
urday night.
Townaend collapsed at his
home and was pronounced
dead on arrivel at Emanuel
hospital here. Before he col
lapsed, he told witness that
Hunter had hit him on the
head with a wine bottle.
Police are also holding Kel-
sie Leo Turner, 40, Portland,

Many motliers who are
much distressed because one
of their children is homo
sexual now want to know It
another child, and later, one
or two grandchildren, might
have to suffer from some
sexual mix-up, I am sure the
risk of this is considerable be
cause in a series of cases I
studied for 10 years practical
ly all of the persons had psy
chotic, alcoholic, or odd rela
tives. This is not theory - it is
actual experience. To illus
trate: a homosexual man told
me that his father's brother
was homosexual. The father's
father was mentally unstable.
My patient's mother was with
drawn, unaffectlonate, sus
picious, and domineering, and
her brother had a severe
schizophrenia.
A brilliant homo sexual
man, who later committed sui
cide, had a homosexual daugh
ter, also a sister and a cousin
who were deaf-mutes, and an
What Is The Law?

The Crime of False Pretenses
Sam bought an outboard
motor and had no blank check
form to make payment. He
asked the dealer to write up
the check. Sam in good faith
said he was short of funds but
would be paid four days later,
and for that reason asked the
dealer to date the check five
days later. The dealer agreed.
When the dealer presented
the check to Sam's bank five
days later, Sam had insuffi
cient funds in his account to
cover it. The dealer seeks- to
prosecute Sam either for the
crime of false pretenses or
under the bad check statute.
Is Sam guilty?
Any person who, knowingly
and with intent to defraud, ob
tains from any other person
any money or property by
means of untrue representa
tion of fact is guilty of the
crime of false pretenses. A
person who obtains money or
property by means of his
check drawn on a bank in
which he has insufficient
funds is guilty of false pre
tenses unless he can prove he
has an arrangement with the
bank for payment of the
check. The courts hold that
the writing of a check repre
sents that the writer has suffi
cient funds to cover it or some
arrangement for Its payment,
Sam is not guilty under the
precise fact of this case. The
courts hold that a post-dated
check is merely a promise to
pay in the future, essentially
an extension of credit by the
person to whose order the
check is drawn. To relieve the
maker of guilt It is essential
that the person to whose
order the check was drawn
knew at the time he accepted
It that it was post-dated. If
Sam had intended that the
fact that the check was post
dated should not be noticed
by the payee, then he would
have been guilty. Sam is not
guilty only because the dealer
knew the check was post
dated and was willing to rely
on what In effect was Sam's
promise to deposit money in
the future to cover the check.
It has been suggested by some
courts that the maker is guilty
even under those circum
stances if he intended at the
time he gave the check to de
fraud the payee.

the "artathon" was sponsored
by promoter Jock White, a
former Las Vegas radio man.

found that several of a homo
sexual's relatives had not
married, but no one could say
why. For instance: An odd,
eccentric, and occasionally
manic-depressive woman told
me that six of her seven broth
ers had been uninterested in
girls and had never married.
One of these brothers had, at
times, been depressed, and
some of them she thought
were interested sexually in
men. The one brother who
married had three sons, none
of whom married. My patient
had had a son who was de
pressed and alcoholic.
A young woman homo
sexual who looked like a boy,
had a paranoid (suspicious)
paternal uncle, an alcoholic
mother, a manic - depressive
maternal grandmother who
looked like a homosexual, and
a maternal grandfather who
was manic-depressive. Anyone
who would like to read of
many more such families, can
turn to my book on Practical
Leads to Puzzling Diagnoses:
neuroses that run through
families (1958, p. 300). .
Much in favor of the heredi
tary nature of homosexuality
is the fact that studies have
shown that if one alike-twin
is homosexual, the other twin
almost always will be homo
sexual. In Dr. George W. Hen
ry's big study of homosexuals
he found as I did, that in
most of the families there
were some odd or eccentric
members, not necessarily ho
mosexual. The great mistake being
made by many men studying
heredity is to look in a family
for only what they want to
find, such as more homo
sexuality. In doing this, they
fall to make note of such ab
normalities as psychoses, al
coholism, epilepsy, hysteria,
suicide, diabetes, mental re
tardation, or vagrancy.
These troubles they were
not looking for. .Professor R.
R. Gage, in his large and in
valuable work on "Human
Genetics," gives much evi
dence to Indicate that sexual
mix-ups are commonly In
herited; and more and more
evidence in favor of this view
is constantly piling up in re
search laboratories.
