Complaint Dismissal
Portland-WPD-The City of
Portland argued in circuit
court Friday for dismissal of
a state sanitary authority
complaint requiring the city
to stop emptying sewage into
the waters of the Columbia
and Willamette rivers.
The city attacked both the
legality of the pollution law
and the right of the sanitary
authority to proceed against
the city.
State Attorney Cecil Ques
seth charged Portland with
creating a public nuisance
that is hazardous to public
health by pouring sewage in
to the two rivers.

Right of Way
Claims Released
The Jackson county court
has signed an agreement with
Chester A. Wise and Mary A.
Wise which releases the coun
ty from all claims on a right
of way for the Pleasant Creek
timber access road, County
Judge' Earl Miller said Fri
day. -
The county has agreed to
pay the property owners $100.
The county court also signed
a resolution to make the
Pleasant Creek rd. part of the
general county road system.,
A suit has been filed against
the county by Chester and
Mary ..Wise over use of the
Pleasant Creek rd. through
their property to provide ac
cess to bureau of land man
agement timber.

erator. Heine Perlman, owner of
the Wagon Wheel grocery
here, said he disarmed the
would-be robber after a scuf
fle and a bullet had been sent
into the ceiling.
Inmates Won't Be
Used at Courthouse
The county court Friday
decided not to use county
prisoners for any more work
details around the courthouse
until liability insurance can
be obtained to cover them.
The decision followed an
opinion from District Attor
ney Thomas J. Reeder, which
stated the county court, has
legal authority to work coun
ty jail prisoners. -However,
the county court has absolute
control and responsibility for
the prisoners while working
on public property. If an ac
cident should occur the coun
ty would be liable, Reeder
wrote. They are not covered
by workman's compensation
insurance, he added.
During other business Fri
day the county court decided
to delay awarding a contract
for courthouse annex awnings
until the next regular agenda
meeting.

Nez Perce Power
To Be Sold at
Cost, Says Group
Seattle - WPD - Nei Perce
power will be sold al cost and
distributed on regionwldo
basis for the maximum eco
nomic benefit of Washington,
Oregon and Itiiiho, according
to a policy adopted here Fri
day by the Washington Public
Power Supply System.
The marketing and distribu
tion methods were outlined in
a statement by ' Owen W.
Hurd, managing director of
the system, ,
The WPPSS has filed an
application with the Federal
Power Commission for a li
cense to build the Nei Perce
project on the Middle Snake
river.
Plans calls for an Intercon
nection of Nez Perce power
with the Bonneville Power
administration's grid system
to avoid duplication of trans
mission facilities and to main
tan and enhance the Integrity
of the federal system, the
statement said.
Consideration will be given
to a supplementary heavy
voltage line to southeastern
Idaho for the development of
phosphate resources.
The directors also said that
Nez Perce wquld be operated
in coordination with down
stream federal and other
plants to achieve optimum
firm power production; be de
veloped for maximum rec
reational use; operated for
maximum floor control and
uavlKiitlon benefit, and bo
equipped to protect fisheries,'
both upstream and downstream,
