His fellow workers knew little about him except that he
had a great interest in girls. His last address was a small
hotel, but he had since checked out.
The search went on. When Engle eventually was found,
he admitted he had been interested in the attractive Phyllis,
but insisted she had refused to give him a date. He gave a
detailed account of his movements the night Phyllis died,
and they proved to be true.
He couldn't have murdered the girl.
Without A lead, Chief Rogers got out the records and
studied the statements given by various witnesses. In
the middle of one, he stopped and reached for the telephone
directory. He made several calls and carried on brief con
versations. Then he summoned a detective. "Kinney's our
boy," he said. "Bring him in."
Charles Kinney repeated his original statement and
denied any knowledge of the murder of Phyllis. Chief
Rogers wasn't impressed.
"Search his room," he ordered.
Detectives made the search and returned with two sig
nificant items: one was a receipt for extra sawdust Kinney
ordered after Phyllis had disappeared; the other was a
pillowcase stained with lipstick that had been tossed in
the laundry hamper.
Confronted with these, Kinney confessed that he had
met Phyllis as she returned home, and she had stopped in
his apartment to chat. They became involved in an argu
ment, and Kinney had lost his head and smothered her
with the pillow. '
He had hidden the body -in the ice bin and )hen ordered
extra sawdust to make sure it was well-covered until he
could dispose of it.
Kinney was convicted Nov. 23, 1945, and sent to prison.
Before he was led away, he asked Chief Rogers:
"Why were you so sure I was guilty?"
"There was a big hole in your story. I called all the book
stores, and you hadn't been in . any of them that night."
"How could they say that?"
"Easy. It was V-J Day, remember? All the shops in Vic
toria, including the bookstores, were closed that night"
