dam on the Deschutes river
lost a round In court Wednesday.
Circuit Judge Herbert
Schwab granted PGE a de
murrer and then gave the
stockholders opposed to the
dam 30 days In which to plead
further. The action makes it
virtually impossible for the
stockholders to force a vote
on the issue this year since
the annual stockholder meet
ing is April 20.
The company has maintain
ed that its board of directors,
not stockholders, has authori
ty to decide whether to build
dams.

Chessman received two
death sentences in Los An
geles in 1948 on convistion of
kidnaping for the purpose of
robbery accompanied by bod
ily harm. The bodily harm.
The bodily harm was a per
verted sex attack on two
women. Chessman's attorneys
argued that the charges on
which he was originally In
dicted carried a maximum
penalty of life Imprisonment.
Other Appeals Possible
If the U. S. Supreme Court
rejects the latest appeal,
Chessman's attorneys will be
free to go into U.S. District
Court in San Francisco and on
up through the federal court
system.

Gibson and Governor Brown.

Home Bombed

section of Atlanta was bomb
ed Wednesday night in a fresh
outburst of racial violence In
the South.
The Incident shattered an
uneasy calm that prevailed
over most of the South where
Negro college students have
been demonstartlng against
segregated lunch counters.
In Nashville, Tenn., police
arrested seven Negroes Wed
nesday night after a young
white man was attacked on a
midtown street. He told offi
cers the Negroes ganged up on
mm, cut his pants with a
knife and hit him with a
piece of hose.

Porter Loses in Passport Plea
Washington - HIPD - A U.S
Court of Appeal! today upheld
a lower court decision deny
ing a claim by Rep. Charles
O. Porter (D-Ore.) that he is
entitled to visit Red China
because he Is a member of
Congress.
The appeals court said that
"although he is a member of
Congrees, that status alone
does not entitle him to be
exempted" from the State De
partment's blanket ban on
travel to the Communist
country.
The court, in an unsigned
opinion by a three-judge pan
el, said the case presented no

brought suit in the District
Court here. He asserted the
Department violated his rights
under the constitution and un
der the passport act of 1926.
He asked the court for an
order compelling Secretary of
State Christian A. Herter to
remove the limitation on Por
ter's passport excluding travel
to Red China.
