To Visit Red China

is pressing his
legal effort in
the courts in

possibly next year. Last Thurs
day his attorneys filed in the
Supreme Court a petition for
a writ of certiorari in Porter's
case against Secretary of
State Christian A. Herter. ' "
District Judge Matthew F.
McGuire on. Sept. 30 dis
missed Porter's motion for
summary judgment by which
the congressman sought to
prevent Herter from further
blocking his passport travel
authorization to Communist
China. Porter has been issued
a passport, but it is stamped
"not valid for travel to
those portions of China.. . .'
under Communistic control."
Deemed Necessary -
Porter had declared, in his
brief filed in District Court,
that during his forthcoming
trip to the Orient he deemed
it necessary "in order fully and
knowledgeably to perform my
legislative functions as a
member of Congress, to visit
Red China to gain first-hand
information concerning condi
tions there, and also as to the
character, purposes and de
signs, domestic and interna
tional, of the political leader
ship of that nation, and the
potentialities and circum
stances of trade between Red
China and the United States."
Judge McGuire noted that
two similar cases were then
pending before the Supreme
Court, one involving a news
paperman, ' William Worthy.
He added that he felt Porter
was asking "that an ordinary
citizen, who happens to be a
congressman, not traveling on
official congressional busi
ness, be granted a passport
when the Secretary of State
concludes it would be to the
best interests of the country
not to do so."
In Porter's petition, de
signed to bypass the Circuit
Court of Appeals and go di
rectly to the highest tribunal,
he says the judge's view of
his role is "incorrect." He
cites a case involving anoth
er congres s m a n named
Charles Porter, who was as
saulted in his. hometown of
Richmond, Va in. 1870.- Con
gress cited the guilty party
for contempt and he was pun
ished, Porter related, because
there was "recognition of the
official and non-private status
of a congressman wherever he
is pursuing his public com
mitments." - -'.
"There is ample recognition
in 170 years of congressional
practice of the fact that most
of .the activities of congress
men have no connection with
their . committee assignments
nevertheless constitute offi
cial business which is attend
ed by all the prerogatives of
their public office," his-peti-tion
asserted. "It pointed out
that Porter was invited, to ob
serve atomic tests in the "Paci
fic, despite the .fact that he did
not serve on the Atomic
Energy Committee,- and this
was . recognized as official
congressional business when
the expense , accounts . were
presented. - ' -V :
Embarrassment Possible .
The petition maintains that
the ''major justification being
advanced by the State" De
partment for the ban 'upon
Communist China passports
relates to the inability of the
government to provide pro
tection to citizens traveling in
China and the consequent
danger that an incident in
volving American citizens de
nied basic protections there
will become a source of inter
national embarrassment or
difficulty." He pointed out
that during a recent Senate
hearing on the passport issue,
the security officer of the
State Department, John W.
Har.es, Jr., contradicted this
point of view when he cited
Porter as an example and said
"I am quite certain that the
Communist Chinese would
make very certain that noth
ing happened to him, because
it would be to their propagan
da advantage to see that noth
ing did." .
Porter is scheduled to leave
for Japan Nov. 3 and to return
Nov. 15, after visiting Okina
wa and possibly Formosa, the
Philippines and Hong Kong.
