Tavern Owner Sues
On Pinball Seizure
Eugene-(CPD-Howard Henry,
owner of a Springfield tav
ern, has brought suit against
Lane County District Attor
ney William Frye and Sheriff
Ed Elder in connection with
seizure of a pinball ma
chine at Henry's establish
ment early Tuesday.
Two sheriff's deputies con
fifcated the machine after
they had won four free games
on the machine in a 40-min-ute
period.
The suit contends that
Henry will suffer "great and
irreparable" damage if the
hiriff and District Attorney
are allowed to continue seiz
ing his machines. Henry
claims that pinballs are not
wamhlintf devices as defined
by Oregon law. He is asking
for an injunction against iur
ther seizure.
Attnrnev Hale Thompson
who is representing Henry
says the suit is a test case of
Oregon gambling laws.
