Judge Urges Personalized Attention For Every Young Defendant in Court

Irving Ben Cooper is especially con
cerned over the handling of juvenile
delinquency cases throughout the
United States and distressed by
what he feels is their mishandling
in manv American courts.
Last vear. about 5.009 defendants
between 16 and 19 yean of age
appeared in Judge Cooper's own
court, and he has become acknowl
edged nationally as one of the out
standing authorities on juvenile de
linquency and probation in the U.S.
This is his 21st year on the bench
and marks what Judge Cooper calls
his "coming of age" as a Jurist.
The following dispatch is the
first of three in which he discusses
what be considers to be society's
shocking failure to cope properly
with young criminals. He tells not
only where he feels the fault lies,
but what can and should be done
to correct it. Judge Cooper's views
go to the heart of a problem that
besets modern America and mil
lions of onr homes.

could bring parents, thousands
of them, into my courts and
have them see a sight that
never fails to warm my own
heart although I have seen it
a thousand times.
It is the sight of young peo
ple who have come perilously
close to the ruination of their
lives-and then pulled them
selves back to decency.
Their heads are held high,
their clothing is neat, their
very manner exudes the inner
feeling of pride and respect
for themselves as human be
ings, their sense that they are
'somebody."
I wish the parents could
have seen these same young
men and women a year or six
months before when they first
came into that same court
room. Then, they were strikingly
different. Some shambled in
with sulky defiance written
a mock contriteness that was
as transparent as it was phon
ey. Some were so frightened
they were in a state of shock.
Others bore the stamp of com
plete defeat, a resignation to
hopelessness.
Real Trouble ;
All of them were in trouble
real trouble. They had com
mitted serious crimes: burg
lary, assault, stealing cars,
gang warfare, narcotics addic
tion, sexual abuse.
They were on the brink of
a life of crime and misery
and despair and degradation
that would pull them relent
lessly into the gutter-and pos
sibly keep them there. They
would be a menace to the com
munity in which they lived
and bring tragedy to others.
The transformation of so
many of those young people
into decent, clean human be
ings, pulling them back from
that brink in time is the great
est satisfaction of our work.
We have found that we can
save as many as seven out of
eight of them.
That is what I want to talk
about: how it can be done.
It comes down to the simple
concept that every young de
fendant must be given- person
alized attention. Mass produc
tion of justice is no justice at
all. If our society is to endure,
we must go farther than the
dictum that the punishment
should fit the crime. It must
fit the person as well as the
crime.
There are courts all across
the United States where,
every day, the judge snaps
off: "Six months.'' "Three
years." "Reform school." He
does it without the slightest
notion of the defendant's real
character and potential as a

Won't Be Taking Chance
"Get him out of society's
hair"-for a little while, any
way. "Throw him in the jug."
In that way the judge won't
be taking a chance on a youth
who laughs at his lenience and
goes right out and mugs an
other woman in a dark street.
Some of the young people
are beyond rehabilitation and
probation ior them is out of
the question. There can be
no dispute about this the
hardened young offender pre
sents a challenge not to be
evaded.
The right to move safely
and unmolested through the
City, to be secure at work and
at home, to be protected
against frauds and schemers,
is the supreme luxury of civ
ilization. For it the commun
ity pays a huge price, and is
intolerant of failure on the
part of its agents and instru
ments. It cannot be patient
with or concerned about the
welfare of offenders while
they threaten its security and
comfort.
It is no news that society
it shot through with various
types of criminal groups at
all levels, from the most bru
tal to the most intellectual,
many protected by every de
vice against discovery and
punishment. A therapy such
as probation for ' these is as
cologne to gangrene. We do
not hesitate to commit the in
sane to hospitals, repeaters
and hardened offenders to
prison, probationers who
abuse the community's mercy
to jail. i
Huge Backlog
But after these are put
away for the community's and
their own good, there remains
a huge backlog of persons
who any average man admits
are "worth saving."
Our courts in New York
City have been more fortun
ate than most in getting the
tools with which to deal just
ly. The main implement has
been probation-strict and un
wavering surveilance of how
they are behaving with the
slightest doubt removed from
their minds that misbehavior
will result in confinement.
For this to work, the judge
must have at the time of sen
tence a complete and accurate
life history of the youth be
fore him.
He must know:
Why did he commit his act?
Others about him have not
got into trouble. What was
there in his experience to
turn him' criminal?
What of his home? His rela
tions with his parents? How
has he done in school? Who
are his friends and compan
ions? What are his hobbies?
What has he seen of love
and marriage and parenthood?
What kind of a job does his
ism or drug aaaicuon m ais
family?
Does He Feel Good
Is he proud of his own cul
ture and group? Does he feel
good that he is a Jew, a Cath
olic, a Negro? What skills
does he have? Whom does he
love most? Hate?
Throughout the land today,

Agreement Reached
Sacramento, Calif.- (UPD -A
meeting of representatives of
Washington, Oregon and Cali
fornia here Saturday ended in
agreement on the principle of
a power tie-up which would
bring surplus Pacific north
west electricity to power-hungry
California.
Spokesmen for the three
states agreed at ,th,e meeting
to hire a private firm to study
the proposal. However, the
conference made no decision
other than to study the mat
ter. California Gov. Edmund C.
Brown has estimated that
some three-billion kilowatt
hours of power from the north
west's Bonneville system goes
to waste each year for lack of
a market.
Brown said if. California
bought some of the surplus
power, it would help keep
electricity costs down in all
three states.

these factors. Most are heart
sick that they must operate
in such fashion, but the com
munity has not seen fit to
help them rehabilitate its own
young people. It "costs too
much." Or "it's mollycod
dling." Costs too much? The real
cost of carrying these youths
over the transition from child
hood into the beginning of
responsible maturity is an in
calcuable mass of material
and social wreckage-damaged
and wrecked family cars, in
creased insurance rates, wan
ton destruction of household,
commercial and community
property, medical bills grow
ing out of carelessness and
foolheardy exploits, irrespon
sible pregnancies and ( births.
Families, relatives, friends,
neighbors absorb a major
share of these costs.
Bud Stage
Youth offenses are the bud
stage of criminality. They fol
low in the main patterns of
adult desires. But there are
less cerebral, less variegated
and more lusty. To consider
youthful crime as something
foisted on anj innocent and
law abiding community rath
er than as an aspect of its
own thought of itself and its
own action is to be naive be
yond sanity..
