Owners Complain
The city building depart
ment had entered a violation
order against the contractor
only after the units were all
but completed. Adjacent prop
erty owners complained that
the sidelot setbacks of the
units were below the mini
mum specified in the city's
zoning ordinance. The con
tractor, Jomes Boyce of Wat
kins . Construction company,
asserted that he had erected
them according to plans ap
proved at city hall.
The1 complainants subse
quently agreed they would be
satisfied if the units were cut
back to five feet from the lot
lines, if a .four-foot cyclone
fence was erected along the
lot lines and if the intervening
ground was graded to prevent
excessive run - off of rain
water.
These conditions, Duff re
ported last night, have been
met. Basis for the variance is
that forcing the contractor to
move the units back to the re
quired setback would have in
volved an excessive hardship.
The council heard a report
from Duff that possibilities
are being explored for rerout
ing the proposed Eastover ter
race sanitary sewer or read
vertising the project in hopes
