has heretofore caused a water
main in the City of Medford to be
laid on Riverside Avenue from
Boyd Street to Earhart Street, and
the Council being of the opinion
that said water main may be used
bv the property fronting on that
portion of said main on Riverside
Avenue from Boyd Street to Ear
hart Street in the City of Medford,
Oregon, and
whereas said water main nas
not. as vet. been caid for and it
appearing to the Council that the
use of said water main as a lateral
water main by said property last
above mentioned will not material
ly interfere with the use thereof

without materially interfering with
the use thereof for the purpose of
water main the purpose for
which it was originally laid, and
the Council proposes to permit the
owners of adjacent property to use
the same ior lateral purposes as
aforesaid.
Section 2. It is the intention of
the Council to assess the property
frontin- on the street wherein
said water main is laid as herein
before last described its proportion
ate share of so much of the cost
thereof as equals the special benefit
wnich will result to said property
from the use of said water main
as a lateral water main of such
size as would be reauired to supply
the property fronting on said
street in case said water main was
not so used and the Council has
and does here determine that the
sum of $2 35 per front foot is the
amount of such special Deneiu ana
the proportionate cost of such a
lateral water main to sucn property
as aforesaid and intends to as
sess said amount against such ad
