Alaska Governor Remains Critical
Seattle, Wash. -JOT- Gov.
William A. Egan of Alaska re
mained on the critical list
here today but was reported
holding his own in a 50-50
battle for life.
Egan, 44, underwent a
two-hour emergency opera
tion Tuesday for the removal
of an intestinal block. He
was flown here from Juneau
Monday after he took a turn
for the worse during conval
escence from a Jan. 6 opera
tion. The fact Egan was holding
his own was termed "encour
aging" by hospital officials.

amount he might take out in
surance - not against mal
practice - but against extreme
ly rare bad luck. Perhaps,
then, the courts might recog
nize such insurance as cover
ing the eventuality, and then
they would not accept a suit
against the doctor and the hos
pital. It would be recognized
that the paralysis or the death
of the patient was due to a
rare happening caused per
haps by some peculiar sensi
tiveness of the men to a drug
which, in hundreds of thous
ands of cases, is used without
any difficulty. : V ;
Another suggestion I saw
which sounded very logical
was. that we should have cer
tain types of cases decided,
not by a jury of people entire
ly ignorant of the subject, but
by a jury of persons highly
trained in the subject. For in
stance; orie of my patients, a
prominent inventor, is mixed
up in a miserable and long-drawn-out
and expensive suit
in which someone has to de
cide which parts of some very
complicated machinery were
invented by whom. Some of
the litigants claim that my pa
tient should not have been
granted a patent because the
principle he used was known
before he filed his papers in
the Patent Office. As my pa
tient says," the problem of de
ciding on such technical mat
ters is so very difficult that
even a jury made up of a
dozen gifted and well-trained
mechanical engineers, well ac
quainted with this particular
type of machinery, would
have difficulties unscramb
ling the mass of facts. Well,
then, why shouldn't we
some day, in cases like this,
get a jury made up only of
engineers competent to read
blueprints? All of which leads
up to a logical idea which is,
can't we some day get juries
of trained scientists to decide
on many mal-practice suits in
which the evidence is so high
ly technical as not to be un
derstandable by a jury of lay
men?. I was so impressed once 40
years ago when one of the
most respected judges in San

I have a case before me in
which a lad of 12 had a frac
ture of the upper arm bone
just below the shoulder. A
good orthopedist set the frac
ture and got a perfect result.
But the father, a wealthy
man, now says that the bill for
$1,000 is : outrageous and he
won't pay it. What do you
think? The expert evidence
given in my court has been
so conflicting I can't- guess
who is right." I just said,
"Your Honor; I have a son of
12, and if, today he were to
get a , fracture like that, in
such a dangerous spot where
a bad result can so easily be
obtained, and if I thought that
by paying $1,000 I could as
sure my, boy a perfect result,
I, who am not a rich man,
would gladly pay the money."
The Judge said, 'That is all
I wanted to know; the fee
will be allowed;" and it was.
What I wonder is why more
often judges can't put a highly
technical and perhaps medi
cal problem up to a complete- j
ly disinterested "Friend of the
Court" who would say just
what he would say to a group
of 100 doctors, all competent
to bawl him out if he were to
say something not the truth.'
Toxemia of Pregnancy '
Many a woman who is going
into her first pregnancy is
unduly concerned about. the
dangers of the toxemia of
pregnancy. If she has a nor
mal blood pressure and no
sign of disease in her heart
and kidneys, I, doubt . very
much if she will suffer from
the toxemia , of pregnancy.
During the first three years
in which I practiced, I did a
great deal of obstetrics in a
big mining camp. I did prac
tically all of the very difficult
obstetrics in the city. In the
less difficult cases, the woman
was taken care of .by a mid
wife. When the midwife real
ized that she was up against
something pretty serious that
she did not understand, she
sent for me. And yet, in all
those strenuous three, years,
I can remember only one case
of toxemia of pregnancy in
which a girl of 19, with her
first child, kept going from
one convulsion into another.
Unfortunately, her husband
hadn't come for me until she
began to swell up and go into
convulsions. In a mountain
shack without anyone to help
me, I quickly applied forceps,
and got a live baby. I also
saved the mother, but I sus
pect the Good Lord helped
me. I. certainly needed help
that day.
Sever Headache After
Spinal Puncture
Several people ask me why
they got a terrible headache
after a spinal puncture. The
theory is that the spinal fluid
keeps oozing for some time
out of the little hole made by
the needle. With this, the
brain comes in too close con
tact with the bony skull,
without the usual cushion of
fluid about it. Unfortunately,
this type of headache is some
times hard to stop and it can
last for several days.
