A RESOLUTION declaring inten
tion of the City Council to con
struct a water main along Woodrow
Lane from Crater Lake Avenue
to Wabash Avenue and to assess
the cost thereof against properties
fronting thereon: and setting a
time and place for hearing thereon.
BE IT RESOLVED by the City
Council of the City of Medford,
Oregon:
SECTION 1. That It is the Inten
tion of the City Council of the
aid city to cause a Six 6i inch
water main to be laid in Woodrow
Lane from Crater Lake Avenue
to Wabash Avenue in the City of
Medford, Oregon and to assess the
cost of said water main on the
property fronting on said street
ii in proportion to the frontage
of said property.
SECTION 2. That the City Coun
cil shall meet In the Council Cham
bers of the City Hall of said city
at 6:30 o clock PM. on the 5th
day of February. 1959. at which
time and place all protests against
the laying of said water main and
the assessment of the cost thereof
on the property fronting on said
street (si shall be heard and the
City Recorder ia hereby directed to
cause this Resolution to be pub
lished once in a daily newspaper,
printed, published and of general
circulation in the said city of Med
ford, not less than ten days or
more than twenty days before the
date of said meeting and a copy of
tms resolution to oe posted tor
a period of ten days prior to said
meeting in five public and con
spicuous places in tne saia city.
SECTION 3. That warrants for
the costs of the aforementioned
improvement shall bear interest at
4 per annum and shall constitute
General Obligations of the City of
Medford. and said warrants shall
be issued pursuant to, and on the
terms and conditions set forth in.
ORS 287 502 to 287.510. inclusive

WHEREAS the City of Medford
has heretofore caused a water
main in the City of Medford to be
laid in Biddle Road from a point
656 feet North of Jackson Street
to a point 988 feet South of Mc-
Andrews Road and the Council be-t
ing of the opinion that said water
main may be used by the property
fronting on that portion of said
main on Biddle Road from a point
656 feet North of Jackson Street
to a point 988 feet outn of mc
Andrews Road in the City of Med
ford. Oregon, and
WHEREAS said water mam has
not, as yet been paid for and it
appearing to the Council that the
use of said water main as a lateral
water main by said property last
above mentioned will not material
ly interfere with the use thereof
for the purpose for which it was
originallv laid, now therefore.
BE IT RESOLVED BY THE
COUNCIL OF THE CITY OF MED
FORD. OREGON.
SECTION 1. That it is the opinion
of the Council that part of the
aforementioned water main laid in
the City of Medford described as
follows, to-wit:
As laid in Biddle Road from a
point of 656 feet North of Jackson
street to appoint sB -teet aoum
of McAndrews Road in tne city
of Medford. Oregon, may be used
by the property fronting thereon
as a lateral water main without
materially interfering with the use
thereof for the purpose of a water
main, the purpose for which it was
originally laid, ana tne council
proposes to permit the owners of
adjacent property to use the same
for lateral purposes as aforesaid.
section 2. it is tne intention
of the Council to assess the prop
erty fronting on the street wherein
said water main is laid as herein
before last described its proportion
ate share of so much of the cost
thereof as equals the special bene
fit which will result to said prop
erty from the use of said water
main as a lateral water main of
such size as would be required to
supply the property fronting on
said street in case said water main
was not so used and the Council
has and does here determine that
the sum of $2.35 per front foot
is the amount of such special Dene
fit and the DroDortionate cost of
such a lateral water main to such
property as aforesaid and intends
to assess said amount against such
adjacent property on account there
of. SECTION 3. The Council will
meet at the hour of 6:30 o'clock
P.M. at the Council Chamber in
the City Hall on the 5th day of
February. 1959. at which time and
place all protests of said assessment.
