What Is The Law?
Thia column it prepared at a public torTico by the
1 Collaga of Law, Willamette University. Salem, to
explain basic lagal principles, not to provide legal
advice. The reader is cautioned not to apply these cases
to his own problems without an attorney's advice, for
differing facts may change the outcome.
Cats and Dogs
Can Inherit Gifts
When Minerva died people
were shocked to discover that
her will gave much of her
substantial holdings to a trust
company to hold for her two
cats. Minerva's heirs contest
ed the will.
The court upheld the trust
but pointed out that since the
beneficiaries of the trust
would by their nature be un
able to enforce it, the trust
would become inoperative if
the company refused to carry
out its provisions.
Gifts Clearly Valid
Gifts to animals in the form
of trust gifts are clearly valid
and enforceable if a large
number of animals will bene
fit from the gift. Such a trust
is "Charitable" and will -be
enforced by the Attorney
General of the state. Taking
care of animals (assuming
they are not predatory) is con
sidered a function of society
and organizations protecting
and preventing cruelty to ani
mals are recognized as chari
ties. However, when only two
cats are to benefit, the Attor
ney General does not enforce
the trust since the public in
terest is not sufficiently involved.
Dogs and cats do vhave
rights before the law but have
not always rated such a high
standing. Through the early
development of the Anglo-
American law there was much
doubt as to the relationship
of man and dog.
Courts gave domestic ani
mals raised for food or for
work full recognition and a
man had an interest in such
animals that would be pro
tected by the law.
However, many courts con
sidered dogs and cats to be
objects of whim and fancy
and not worthy of legal sanc
tion. Judges often disagreed
on the subject. Some judges
referred to dogs and cats as
faithful and loyal animals
while others labelled them as
mean and nasty creatures.
In modern times, the dog
and cat have assumed the
stature of cows and horses in
the eyes of the law. The Ore
gon legislature has passed a
law stating that a dog can be
the subject of property and
will be recognized in a court
of law 'as being owned. Al
though no such law has been
passed relating to cats, there
seems to be no doubt but that
th feline group enjoys the
same rights as canines.

the costs of operating this office very carefully in view
of the consistent budget increases which have occurred
in the past few years.
If elected Madden will show fairness to both political
parties and will seek to encourage registration and voting.
If elected Marv Madden will not encourage or permit
his deputies to promote his candidacy by paid political
advertisements or by letter. If elected Madden will not
seek to extend his influence beyond the definition of the
office. Marv Madden's experience and qualifications are
such that he is capable of doing any job in this office
and he will devote his full time to working at it.
Madden will cooperate with other elected officials for
harmonious, efficient and economical administration of
the office.
Marv Madden will encourage registration and voting by
providing full and accurate information about registration
requirements and by stabilizing the location of polling
places.

Deer Hunter Finds Jeep

Cave Junction-Rudy Smith
reported finding a jeep hid
den in the underbrush along
the Illinois river while deer
hunting last week end.
Deputy Sheriff Les Tyth-
cott said it is believed the
jeep is the one reported stolen
last April from a mining claim
back of Eight Dollar moun
tain. At that time, Tythcott
tried to find it, but was un
able to trace it in the woods.
It belonged to Russell Lee of
Kerby.
Home for the week end
from the University of Oregon
was Patsy Rogers, daughter
of Mr. and Mrs. Ted Rogers
of O'Brien.

luck with the auxiliary furn
ishing hot rolls and coffee.

tions such as wrecking yards near residential areas could be prevented
or corrected.'
