Defective Equipment Can
Mean Negligent Homicide
John Smith was in a hurry
to load some logs onto his
truck and ge them to the saw
mill. He loaded six logs, each
over 16 feet long, onto the
truck and strapped them to
the truck with two old, frayed
cables. On the way to the
mill the truck ran into wet
pavement on a sharp curve
and skidded off the highway
and up an embankment and
overturned. As the truck roll
ed over on its side, the cables
securing the logs snapped and
one of the logs rolled out on
to the highway. The driver of
a following car was unable to
avoid hitting the log and was
killed when his car crashed
into it.
John was not hurt. The
death shocked and saddened
him, but he felt that the per
sonal injury liability coverage
in his truck insurance policy
would protect him from fi
nancial loss. The thought that
he might be in serious trouble
did not occur to him.
Indicted for Crime
John was sure that a mistake
had been made when, follow
ing an investigation of the ac
cident, he was indicted for
the crime of negligent homi
cide. He was told by the dis
trict attorney that he faced a
possible penitentiary sentence
if convicted. John reasoned
' that he might have been neg
ligent, but he was sure that
he could not be convicted of
negligent homicide unless he
were guilty of gross negli
gence. Was John right in his
opinion?
Unfortunately for John, he
' was wrong. He is in serious
' trouble and may indeed be
convicted and sentenced to
the penitentiary. An Oregon
statute provides that when
: the death of any person oc-
curs within one year as the
result of injuries caused by
the driving of a vehicle in a
grossly negligent manner, that
the person driving the ve
hicle is guilty of negligent
' homicide.
Proof Not Sufficient
Proof of ordinary negli
gence or carelessness is no
longer sufficient in Oregon to
establish guilt in most negli
gent homicide cases. It is
true, however, that when the
death is caused by the driving
of a vehicle which is known
or should have been known
by the driver to be defective
ly loaded or defectively
equipped, the driver of such
a vehicle is guilty of negli
gent homicide. John's con
duct may not have been
grossly negligent, but he knew
or should have known that
; his truck was defectively
loaded.
Another Oregon statute
provides that loads of logs
more than 16 feet in length
shall be secured by at least
four binders, each having
. breaking strength of not less
than 15,000 pounds. Oregon
law also expressly provides
that no vehicle shall be driven
or moved on any highway un
less it is so constructed or j
loaded as to prevent its con
sents from dropping, sifting,
leaking or otherwise escaping
therefrom.
